North Dakota governor signs 'heartbeat' abortion ban

North Dakota on Tuesday adopted the most restrictive abortion law in the United States, as the governor signed a bill that bans the procedure in most cases once a fetal heartbeat can be detected, as early as six weeks.

Supporters of abortion rights said they would challenge the measure in court.

Governor Jack Dalrymple on Tuesday also signed a bill that bans abortions based solely on genetic abnormalities, the first state ban of its kind, or based on the gender of the fetus.

North Dakota is the latest state to pass measures to restrict abortions. Arkansas lawmakers earlier in March approved a ban on most abortions after 12 weeks of pregnancy that could take effect in August if it survives expected legal challenges.

Several states ban most abortions after 20 weeks of pregnancy.

Dalrymple, a Republican in a state with a Republican-controlled legislature, said the constitutionality of North Dakota's effective ban at six weeks into pregnancy was an open question. He said lawmakers should appropriate money to a litigation fund for the state attorney general to defend against any possible challenges to the law.

The "heartbeat" bill provides exceptions if an abortion would prevent the death or irreversible impairment of a pregnant woman, but provides no exception for rape. It sets up a direct challenge to the Supreme Court's decision in Roe v. Wade that legalized abortion in 1973.

CHALLENGE PLANNED

The Center for Reproductive Rights said it plans to file a legal challenge to the six-week ban before it takes effect on August 1 on behalf of North Dakota's only clinic that provides abortions, the Red River Women's Clinic in Fargo.

You’re thinking too much ... this is a VICTORY even if it only lasts a few months ... Just think of the clinics being starved out of business never to return because we could hit them with another statute that could leave them hanging for years... That’s the way they operate ,, throw it against the wall and worry about it sticking later (if at all) ,, it’ll have an effect in the meantime.

“Actually, I do know a few tree huggin’ PETA loons and I will say that they are intellectually honest in that they are totally against abortion. “

They must be the only “few”. PETA hates conservatives, Christians, hunters, and most meat eating, pro-life folks. And their track record of blatant and sometimes militant attacks on just about anything conservative proves it.

I remember the magic of that day, going with my wife to our first ultrasound of our firstborn and the love I felt for that tiny creature with its fast-thumping heart. That creature has blossomed into a beautiful, artistic ten-year-old girl in a gifted and talented program.

I was pro abortion for years, whenever the woman wanted it.
One day, I was reading a story on FR and it linked to some pictures of aborted babies (I believe it was regarding a law suit about showing the pictures).

From that day on, I’ve been against abortion except in special, and very narrow, circumstances. I think people do need to see the pictures, and now we have ultra sounds that are like 3-D and you see such detail, I could no longer support a purely elective abortion.

Maybe different pictures work for different people. Some need to be shocked by the results of abortion. Others may need to see the beauty of a baby in utero, using the new technologies.

Anyway, people can change. It’s worth it to keep trying.

Same here. I was pro-choice at least, supposing that I was doing women a favor by having such a position.

After learning about exactly what happens, I came to believe the procedure was as much violence against women as it is against the fetus. Or at least it is violence against the spirit of womanhood.

The sad thing is that 150 years ago, at least a few months into a pregnancy, nobody would have needed such evidence as you and I were provided.

So much for society becoming kinder and more enlightened.

Just one more reason to give Fargo to Minnesota.

That can’t be allowed to stand. The Supreme Court will rule, and most Democrats and other liberals will agree, that every live birth represents a falure on their part. A hearbeat comes dangerously close to approaching a live birth.
