Update: Obama claim on background checks moved from ‘verdict pending' to 2 Pinocchios

“The law already requires licensed gun dealers to run background checks, and over the last 14 years that’s kept 1.5 million of the wrong people from getting their hands on a gun. But it’s hard to enforce that law when as many as 40 percent of all gun purchases are conducted without a background check.”

— President Obama, remarks on gun violence, Jan. 16, 2013

“Studies estimate that nearly 40 percent of all gun sales are made by private sellers who are exempt from this requirement.”

— “Now Is the Time: The president’s plan to protect our children and our communities by reducing gun violence,” released Jan. 16

Earlier this week, we gave this claim a “verdict pending.” We said we faced a bit of a conundrum because the 40 percent statistic was based on a single, relatively small survey of 251 people from nearly two decades ago — but that foes of gun control had made it difficult for further research to be conducted.

We also gave kudos to Vice President Biden for acknowledging that the statistic might not be accurate. So we said we would be watching carefully for how the statistic would be used by gun-control advocates in the future.

We also noted that the microdata used in the original survey could be accessed by researchers. A pair of readers, including John R. Lott Jr. (a noted skeptic of gun restrictions) downloaded the data and presented us with an Excel analysis to argue that the words used by the President and the White House—“gun purchases” and “gun sales” — were inaccurate...

Why would a criminal submit to a background check any way?

I can’t help but wonder if BO himself could pass a background check. If he is using a fake SSN would it kick him out?

What’s next taxing garage sales and lemonade stands?

My guess is that 99% of those declined were either errors or people who had no idea they had committed some relatively minor crime in their past.

The number of hard core criminals actually kept from obtaining a gun by any means would be close to zero.

I should have said “people who had committed some minor crime in the past that they didn’t know would block their over the counter purchase.”

Or mistaken identity. My buddy found out he was 6’5” tall and had a warrant out for his arrest in Texas. He is 5’7” and lived in Okolahoma when he “commited” the crime.

For several years I always got a hold on my approval. It would usually get approved within an hour or two but it was so irritating that it kept me from buying several times as I didn’t want to have to wait for approval.

I have never been charged and certainly never been convicted of any crime except minor speeding and not even that for 30 years.

For some reason it no longer does that but you can see how irritating that would be.

I wonder if they are keeping a record. The only reason you are getting a background check is to purchase a firearm.

Felons cannot be forced to register their weapons, violates their 5th amendment rights.

All a failed background check means is that the criminal doesn't get THAT weapon.

Obastard lies, like he does with every word, when he says it keeps them from getting A weapon.

Someone told me they put a hold on anyone who has had an FBI check run on them.

I have no idea if that is right or not but I worked at a job for most of my life which required an FBI check. For some reason they kept asking me to submit additional fingerprints. After the 3rd request I just ignored them. Nothing ever came of it.

During training, I got a phone call from our internal security asking me to correct some odd information. I immediately knew what they were doing and just laughed it off, giving them the info.

I later talked to one of them and he said it was a stupid idea. He said they did the same thing to him thinking he would just blurt out some evil deed he had done in the past.

So there were some questions about my past but there should not have been and I guess they finally let it go.

They sure do. First time was at one of the Federal Agencies who were in the same Federal Bldg. where I worked.

Second time was by the local Sheriff. They had a guy who clearly knew what he was doing so I know they had a good set.

The third time, I just ignored the request. By that time I decided it was just their was of trying to make me nervous.

I do remember several years later I decided to look at my personnel records. I was pleasantly surprised at what good interviews they had given on me. Two, one a Sergeant at Lackland and another at a Summer retreat had literally said I was the best they had ever had.

Then I got to wondering. They had interviewed every person I had ever had close ties to including former neighbors. Then I realized a former boss was not in the file. I actually liked him OK but another worker once told me he was furious at me for questioning something he once said.

They remove any derogatory info after I think 3 years. That had to be it but I have no idea what he told them.

Entering your SSN is “optional” on the form.

I never had to submit fingerprints to purchase a gun. They just call a number and that’s it. Takes less than five minutes.
