Register … or Rebel: How Many New Yorkers Will Defy The New Gun Law?

Already, there are signs that Governor Cuomo and his allies underestimated the pushback.

As draconian, ill-advised, and possibly unconstitutional as the New York Secure Ammunition and Firearms Enforcement (NY SAFE) anti-gun law was when it was hastily signed into law, it might have been far worse — this according to a New York legislator who fought against the bill.

Assemblyman Steve McLaughlin has released documentation showing rejected Democratic proposals for the NY SAFE Act. They included these:

Assemblyman McLaughlin explained the intent of his Democrat colleagues in Albany on his campaign site:

Assemblyman Steve McLaughlin (R, C, I-Melrose) today revealed a 15-point anti-Second Amendment wish list that Democrats lobbied to be included in the final New York Secure Ammunition and Firearms Enforcement (NY SAFE) Act. McLaughlin called the list the “second phase” of a gun-grab agenda targeting responsible firearm owners that downstate politicians have been supporting for years.

“First the new gun-control bill made criminals out of law-abiding New Yorkers. And the radical, anti-Second Amendment proposals outlined in this wish list suggest the second phase of the plan: confiscation,” said McLaughlin. “When downstate politicians criminalize responsible gun ownership, they only empower criminals.”

The rejected proposals seem to mirror — at least in part — the desires of New York Governor Andrew Cuomo, who had publicly entertained gun confiscation and forced buybacks.

The provisions of the NY SAFE Act that did become law still demand far more of New Yorkers than many gun owners are willing to comply with. For example, one of the requirements of the law is that all newly classified “assault weapons” must be registered with the New York State Police by April 15, 2014. Many New York guns owners are intent on refusing to register their firearms:

Assault-rifle [sic] owners statewide are organizing a mass boycott of Gov. Cuomo’s new law mandating they register their weapons, daring officials to “come and take it away,” The Post has learned.

Gun-range owners and gun-rights advocates are encouraging hundreds of thousands of owners to defy the law, saying it’d be the largest act of civil disobedience in state history.

“I’ve heard from hundreds of people that they’re prepared to defy the law, and that number will be magnified by the thousands, by the tens of thousands, when the registration deadline comes,” said Brian Olesen, president of the American Shooters Supply, one of the largest gun dealers in the state.

Officials estimate at least 1 million semiautomatic rifles are owned in the state, sources said.

And come April 15, 2014 — when Cuomo is expected to be running for re-election — they all have to be registered with the State Police.

But because the rifles have been legal but unregistered until now, authorities don’t know who has them or where they are located.

State officials will be nervously watching the registration figures to see how many gun owners comply, sources said.

New York has estimated that there are one million firearms that fit their new definition of an “assault weapon,” and they are concerned that a large number of citizens will rip the teeth out of the law by simply refusing to register their arms. Perhaps hundreds of thousands of New York’s most law-abiding citizens are likely to make the choice to rebel against an unconstitutional law that violates their Second Amendment rights.

Perhaps of even more concern to Governor Cuomo and his anti-gun allies: this high level of resistance arose before Assemblyman McLaughlin released the list of confiscatory amendments Democrats had wanted to include in the NY SAFE Act.

NY Democrats have tipped their hand on their gun-control agenda, revealing to citizens that confiscatory disarmament of the civilian population is their goal, and that the “slippery slope” is no fable. They grossly miscalculated the public’s acceptance of their assault on the Second Amendment. What that means for the future in New York remains to be seen.

This is a tough question for the Christian gun owner. Romans 13 and 1 Pet. 2 tell the believer to obey government.

The former is based upon a complete misreading of Paul's letter to the Romans. In the Roman enclave of the day, per the Treaty of the Maccabees, the leaders of the Jewish people, "appointed by G_d" were rabbis. They had their own laws, their own judges, and their own policing separate from Roman civil authority.

Not so much. We know from the Founders’ writings what they intended the 2nd Amendment for, and being the unorganized militia to oppose tyranny is a constitutional function. In other words, it’s obedient to our government.

Yes, it is a Federal Law that prohibits the government from doing so, unless they have a reason (like a gun used in a crime and a serial number where they can ask the mfr what shop got that gun and that they want to match with a name all backed up by an accompanying court order). BUT, these Democrats are TRICKY...they’ll get that damned info in any way necessary.

What, say, precludes them writing a law that causes the gunshop to transcribe some information from these forms?

You have to realize these are the same kinds of tyrannical zealots that existed in Germany in 1935, or in China today....those same people who are only doing it for the ‘children’ now are the same ones that have butchered millions in the womb. They are the same people that will stand at the back of your head with a pistol and blow your brains out and let you fall into a hole their bulldozers dug - all because ‘you just won’t see the light’. It’s just a matter of time.

Welll, our Revolutionary ancestors were by a large firm Christians, but that did not deter them in rebelling an oppressive government. They were, after all, loyal subjects of the King at that time “When in the course of human events ...” and all that.

Memo to self: 1) File Lawsuit, 2) Get injunction stopping enforcement, 3) Put case into appeals, 4) Throw the bums out of office while awaiting trials, and 5) Change law. In the event of a loss on all counts, move out of state or refuse to comply.

Nothing like an ill thought out law to make thousands of honest citizens felons while doing nothing to control the criminal population.

Okay, how about this? NY decides somewhere in the language they are going to enforce a special tax on owners of certain type weapons. They pass (or likely have already passed) a law, rule, regulation that asks for the name, address and et ceteras on anyone who purchased so and so. No, they don’t want the serial number; they’re just looking for tax information! Don’t underestimate these people! That’s what happened to the Jews in Germany.

Well, that's quite easy to answer...

Legally licensed and law abiding citizens may or may not defy the law. For arguments purposes, let's call it 50-50.

Not-licensed and non-law abiding people will ALL defy the law. Let's call this 100%.

So, to find out actual numbers, we need to know the ratio of law-abiding to outlaws. Based on the above, if that is 50-50 as well, then 25% will obey, and 75% (half law-abiding and ALL outlaws) will not obey.

The Bible does not command believers to do anything illegal or immoral. In my opinion the New York gun law is both of those things and believers are not obliged to obey an unjust law.

St. Augustine addresses this point in his famous comment: “An unjust law is no law at all.”

No one has an obligation to obey injustice. To the contrary, both Peter and John preached The Word after the Romans made Christianity illegal and I can think of no better example of Christians resisting injustice than this.

Up here in God`s Country we got thousands of weapons brought home by our fathers and grandfathers after WW2 and Korea, `Nam-. We got BAR`s, CHICOM tommy burps from NK`s, AK47`s from `Nam- These SOB`s will face a formidible army of unregistered weapons. I got weapons I bought in 1950`s at the hardware store-as a 14 year old- it was legal in NY State then— never had to register anything then. These Cuomonistas SOB`s will get the unexpected return from my investment.
