‘Reopen Sesame sex suit’: Accuser wants to undo Elmo deal

The man who accused Elmo’s puppeteer of sexual misconduct reportedly wants to recant his recantation.

Sheldon Stephens, 24, last week withdrew sensational claims that, as an underage teen, he had a wild fling with Kevin Clash, the voice behind the beloved Muppet Elmo.

Now Stephens is interviewing lawyers in hopes of ripping up the $125,000 deal he reached with Clash, 52, to deny there was any illegal sex, according to TMZ.

Unless Elmo and the accuser got married, he could be compelled to testify.

Interesting thought here:

If a minor was subjected to criminally conducted sodomy, then later as an adult "married" the perpetrator (under the change of definition in some states), would this "partner" be prohibited from testifying against the perpetrator, as the wife in a traditional marriage would not be permitted to testify against her husband? Especially, if the couple were "united" in a same-gender marriage state, but now living in a state where same-gender mutual gratification was not seen as a marriage but as sodomy?

Well, I don’t think they are prohibited from testifying (it certainly doesn’t work like that in divorce court), they just can’t be compelled to testify against their spouse. If they want to testify, they are still free to do so.

As for the gay marriage issue, I believe that, according to DOMA, a state doesn’t have to honor gay marriages performed in other state, if they contravene the first state’s laws. So, I think that would probably apply to the ramifications of testifying in court also.

Kevin Clash, the voice of Elmo, has resigned from Sesame Street ... in the immediate wake of a new lawsuit accusing him of having sex with an underage boy — the second such allegation in 2 weeks.

TMZ broke the story ... Clash is being sued by Cecil Singleton, who claims he met Kevin in a gay phone chat back in ‘93 ... when he was 15 and Clash was 32.

Sesame Workshop says, “Unfortunately, the controversy surrounding Kevin’s personal life has become a distraction that none of us want, and he has concluded that he can no longer be effective in his job and has resigned from Sesame Street. This is a sad day for Sesame Street.”

Sesame Workshop had previously told TMZ, “Elmo is bigger than any one person.” That was in response to the initial underage sex accusation from Sheldon Stephens.

As TMZ previously reported ... Stephens signed a $125,000 settlement with Clash, but has since expressed regret over signing the deal which required him to recant his claim.

Again, I'm not a lawyer, so you may be right. But since that whole thing is dynamic, what will "settled law" in it be? I hate to think of the ways it could be twisted.

DOMA aside, their is a clause in the Constitution itself - name of it escapes me for now - that means states don’t have to recognize laws from other states on any issue not just gay marriage IF those laws conflict with their own states laws and legal precedents.

As to DOMA, I thought it was a law that stated the FEDERAL legal position on marriage as it applies to any federal issue and did not attempt to legislate for states on the issue.

Obama refuses to defend DOMA in any lawsuit in the courts where it is an issue, so right now DOMA is defenseless. Yes it still on the books but the regime through its precepts under the bus...

OK the clause I’m thinking of is Full Faith and Credit, and it’s not the words of the clause that exempt states from having to recognize gay marriage it’s the INTERPRETATION of the clause which has been that marriages and other civil proceedings are not binding on states whose public policy is in conflict with for example recognizing gay marriages, divorces etc.

I didn’t know what DOMA referenced on that issue and in regard to the states’ rolls, but whatever it says, there is a legal precedent going way back that finds an exception under Full Faith and Credit for such issues as gay marriage...which is not dependent on DOMA.

Thanks again on this issue. But all I see is the gates of Hell being opened up, to blot out standards of decency being required in community behavior. What a stain of sinful behavior is evidenced in the moral character of those trusted with the development of the souls of little children! Pfaagh!
