Ex-Carmel teacher claims discrimination over breast feeding in lawsuit

A former teacher at the Carmelo School has filed a lawsuit against the school and the Carmel Unified School District for discrimination and wrongful termination for the school's failure to accommodate her needs as a new mother.

In the lawsuit filed Oct. 30, Sarah Ann Lewis Boyle of Pacific Grove said her troubles with the Child Development Center began in September 2011. Boyle was due to come back to work on Oct. 3, 2011, and she told manager Laura Dunn she would need about 15 minutes between 9 and 11 a.m. every day to pump her breasts. Dunn reportedly told Boyle to start "training my breast not to make milk between the hours of 7 a.m. and 1 p.m." so that she would not need to pump.

According to Boyle, Dunn practically told her to push the feedings further and further apart. "The effect of this advice was to starve (the baby) slightly," Boyle said.

Boyle consulted with her physicians, who advised her to refer the matter to the human resources department.

Barbara Beck, senior director of human resources, reportedly told Boyle it was all a misunderstanding and arrangements would be made for the mother to accommodate the feeding of her newborn. But the arrangements were never made, so Boyle was forced to pump her breasts with little privacy until her baby was weaned off breast milk, according to the lawsuit.

This is crazy. She can’t do it at lunch time? Why does it have to be between 9 and 11? This doesn’t seem like an unreasonable question.

Why doesn’t she take all that maternity leave that Clinton gave her?

LOL - obviously not being a female that has breast-fed, you wouldn't have much of a clue. Also, I'm a male, but I know what my wife went through - saw first hand.

The trouble is that milk builds up and causes the mother great discomfort - and that only grows greater with the passage of time. And there are a couple of other problems associated that which the ladies here can enlighten you regarding...

I lived in Carmel for years —the town is quaint, rich, and liberal as heck. I’m sitting 4 miles from Carmel, right now.

I hope she wins millions from Carmel —I love the town and beach, but loathe that school system.

They go on, and on, and on about building a perfect society, and aren’t illegals wonderful, blah, blah, blah, but when they have to LIVE UP ot what they say, well here we see the result.

Sounds nuts, but yeah, I hope she win$$$$ big time.

The high school just finished building what resembles a countryclupb or a hangar for the Hindenberg —I hope she gets to move in.

Since I have actual experience in breastfeeding and working a full time job, allow me to weigh in on this one.

Yes, it is absolutely correct that when you breastfeed an infant, you can eventually time/train your body and the baby to a specific feeding schedule, if needed.

Four hours between feedings/expressing is pushing the envelope, as far as breast milk production goes, particularly within the first six months.

I was fortunate in my employer when I had my baby.
I found a daycare facility five minutes away from my workplace, and was able to schedule my “lunch break” much like a diabetic has to schedule timed meals.
No matter what was going on in the office, I had to leave or take a break around 11:00.
It is a natural female bodily function.
Pain sets in quickly if the milk is not expressed.

I agree that requiring a 15 minute break in a scheduled two hour work window sounds odd, but I can tell you that a 7am-1pm instruction to “adjust your breast milk production” is just not physically possible.

If the woman only worked two hours a day, between 9am-11am, I agree that it would be an unreasonable accommodation for her to expect a 15 minute break.

But that doesn't appear to be the case here.

When breasts are full, it’s painful, and they leak. It’s not possible to hold it like when you have to pee. The milk will come out, ready or not.

Look....I click on these stories expecting to see some evidence so I can determine the level of guilt or innocence.....

I remember being quite stunned as a 12 year old boy at tennis camp in Carmel in 1973 to see a woman openly breast feeding her baby.

That just never happened in Seattle. Too darned cold!
