Petraeus Affair: Military Can Prosecute Adulterers

Retired Gen. David Petraeus, who resigned as CIA director last week after admitting an extramarital relationship, could possibly face military prosecution for adultery if officials turn up any evidence to counter his apparent claims that the affair began after he left the military. The affair between Petraeus and his biographer, Paula Broadwell, both of whom are married, began several months after his retirement from the Army in August 2011 and ended four months ago, retired U.S. Army Col. Steve Boylan, a former Petraeus spokesman, told ABC News. Broadwell, 40, had extraordinary access to the 60-year-old general during six trips she took to Afghanistan as his official biographer, a plum assignment for a novice writer. "For him to allow the very first biography to be written about him, to be written by someone who had never written a book before, seemed very odd to me," former Petraeus aide Peter Mansoor told ABC News. The timeline of the relationship, according to Patraeus, would mean that he was carrying on the affair for the majority of his tenure at the CIA, where he began as director Sept. 6, 2011. If he carried on the affair while serving in the Army, however, Patraeus could face charges, according to Article 134 of the Uniform Code of Military Justice, which reprimands conduct "of a nature to bring discredit upon the armed forces." Whether the military would pursue such action, whatever evidence it accumulates, is unclear. As the details of the investigation launched by the FBI unraveled this weekend, it became clear that the woman at the heart of the inquiry that led to Petraeus' downfall had been identified as Jill Kelley, a Florida woman who volunteers to help the military. She is a family friend of Petraeus, who Broadwell apparently felt threatened by.

When I was in the Army, a Sergeant and Lieutenant came to blows because the Sergeant caught the Lieutenant fooling around with his wife. It wasn't the Sergeant that got booted.

This is only salacious material designed to deflect the attention from Obama. I don’t care if Patreaus banged the entire Rocketts Dancing Troupe, get to the bottom of the neglect of duty or any blackmail that was possible by nefarious individuals or campaigns.

As head of the CIA, Petraeus may have had access to information about 0bama that could be very interesting - e.g., his REAL BC and place of birth, details of rumored homosexual trysts, details about his activities in Indonesia, Pakistan and while in college, as well as, his involvement in Fast and Furious, passing weapons to Mid East radical groups and of course his traitorous actions regarding Benghazi. I don't think it is wise for the 0bama regime to try to smear him over an affair with all this potentially damaging info that could be brought up. There's got to be much more here than meets the eye. What am I missing?

Every one of them is different in one or two relevent factoids...or unfactoids as the case may be. I am starting to think these nitwits have been told to just go at it with gusto...and they have.

Question: Would the FBI have been able to investigate Petraeus if he was still in the Middle East or did he have to be on American soil?

Probably a silly question but it seems the affair was pretty well known so wondering on why O promoted him to CIA knowing this (and I think O did know) if not for reasons to destroy him.

Yes you are correct. The moral and ethical lapse is being carefully used to create a huge dust storm to cover up the really important issues of the circumstances surrounding the Benghazi incident and what really lays behind Fast and Furious.

Yes, and both the gun running operation at the heart of the Benghazi incident and fast and Furious are CIA operations. DOJ is just being the beard for Fast and Furious real operators.

We need a timeline. I wouldn’t think the Army would do anything if the affair only took place after he retired. If he had an affair on Active Duty, then, yes, they could call him back to Active Duty even for just one day to punish him. Would they? Probably not unless someone was pushing it. The Army probably already has The Inspector General watching this just in case. Most Army Officers don’t realize they are Army Officers until they die. Once you’re sworn in as an Officer, your name is in the Army computer until you die. Broadwell is a different story. It would actually depend on her status at the time she had any sexual contact with Petraeus. If she was on Active Duty, then, yeah, I believe they can go after her, if they want to. If she was in weekend status or Annual Training (2 week) status or just ready reserve or “civilian” status, then it becomes much tougher. And like anything else, it depends on how mad the Army is and how good a lawyer she gets.

Let me get this straight: A military man can be prosecuted and jailed for having sex out of wedlock with a woman, but it's "Okay" to cornhole another gay üntermensch absent legitimate marital status?
