Actually, Gore v. Bush does not apply. SCOTUS ruled it ap[plied in that case only and is not to be considered precedent or guidance in any other case.

But the FL Circuit Court, Appellate Court and FL Supreme Court all ruled that you can't cherry pick ... Gore v. Bush upheld that decision but never reached down .... no?
