Madison County judge appoints special prosecutor to look into forged petitions

A Madison County judge has appointed a special prosecutor to determine if felony forgery charges will be filed following an investigation into signatures on Independence Party petitions.

Madison County Undersheriff John Ball said three residents filed police reports in September after learning that their signatures appeared on petitions submitted by the Independence Party in support of New York State Assemblyman Bill Magee (D-Nelson), Madison County District Attorney William Gabor and Oneida Common Council candidate Helen Acker.

The residents said they never signed the petitions, which were circulated by volunteers from the Madison County Independence Party in July, Ball said.

After an investigation, the sheriff’s department turned its findings over to the Madison County District Attorney – including a recommendation for a second-degree forgery charge, a felony, Sheriff Allen Riley said Thursday.

Last week, Madison County Judge Biagio DiStefano appointed a special prosecutor to handle the case.

Ball said the prosecutor would determine if charges can be filed or presented to a grand jury.

Magee’s petitions were disqualified by the New York State Board of Elections. The 22-year incumbent has said he had no knowledge of the petitions which were passed on his behalf.

Gabor and Acker will appear on the Independence Party line on Tuesday’s ballot.
