NY Senator Says She Expects to be Arrested
State Sen. Shirley Huntley from Queens is facing New York City Councilman James Sanders Jr. in a tough Sept. 13 Democratic primary.

A veteran New York state senator said Saturday that she expects to be arrested Monday in the state's continuing investigation into the use of pork-barrel grants by legislators.
Sen. Shirley Huntley, a Queens Democrat, didn't indicate what the charge against her might be. Huntley founded a nonprofit social service and education group that Attorney General Eric Schneiderman is investigating, and she funded it in part with state grants. Indictments accuse some of the groups' executives of theft. Huntley denies wrongdoing.
In December, four people were indicted on charges they schemed to pocket pork-barrel grants from Huntley, who was close to two of the suspects and who later covered it up. Two officials with the nonprofit, The Parent Workshop Inc., were accused of grand larceny and filing false documents to get $29,950 for work they never did teaching parents how to navigate the New York City school system.
Huntley founded the nonprofit in 2006.

Huntley shouted "It's a great day," as police took her away. That means, "these idiots nailed us for a piddling $30,000----we got millions in secret bank acounts---and we planted financial bombs in state budgets that pay us for years to come."
BACKSTORY The indictments charged Parent Workshop President Patricia D. Savage, who worked as a Huntleys senate aide, as well as Lynn H. Smith, the nonprofits treasurer, with being involved in a scheme to steal taxpayer money. David R. Gantt, a consultant, and Roger N. Scotland, president of the Southern Queens Park Association, were also charged with falsifying records.
NY State Sen Huntley founded The Parent Workshop in 2006, eight months before being elected. Once in office, she authorized a $30,000 grant--a member item---and tried to send another $125,000 a year later.
Huntley's phony $30,000 member item went to so-called consultants....... Sherman Russell, 71, who received $15,000 in 2008 and 2009 from the nonprofit, purportedly to conduct workshops for parents and students on navigating the school system, records show.
"Consultant" David Gantt was purportedly paid $15,000 for conducting workshops for parents and making "outreach visits" to schools and community groups, according to documents submitted by The Parent Workshop to the state for payment.

EXCERPT/EDITED Investigators are probing whether Democrat State Sen. Shirley Huntley received kickbacks from two aides charged with stealing $30,000 in taxpayer funds from her bogus nonprofit....
Huntley earmarked the funds called "member items" for her charity, Parent Workshop, and may have gotten a cut of the money, according to state officials briefed on the investigation.
Huntley, the Queens Democrat and her alleged accomplices attempted to cover their tracks with false documents, a state official said. Theres no clear paper trail, the state official said. So many things could have happened with the money.
Huntley turned herself in after a grand-jury probe began closing in on her charity and as one of her former accomplices flipped on her. Roger Scotland, the former $125,000-a-year president of the Southern Queens Park Association, is now cooperating with prosecutors. He was charged in December with creating fake records that purported to show that the Parent Workshops taxpayer money was going toward seminars which prosecutors say never actually occurred.
The indictment against Huntley, 74, describes a witness who testified before a grand jury in Nassau County Criminal Court that the senator drafted a fake letter for the new president and CEO of the Southern Queens Park Association. in an attempt to dupe investigators. Huntley and her co-defendants include: Patricia Savage, the president of Parent Workshop, and Lynn Smith, Huntleys niece. Both are charged with grand larceny. Also indicted was David Gantt, a consultant who allegedly doctored paperwork to hide the alleged embezzlement.

REFERENCE---Huntley's indictment include govt fraud and other crimes: charges of conspiracy, tampering with physical evidence and falsifying business records. Falsified records included:
* One handwritten letter Huntley wrote to Savage allegedly from a group called the Southern Queens Park Association, which supposedly hosted the charitys workshops.
* Four documents from David Gantt and another so-called consultant claiming to have received payments for their work.
* Twelve fake fliers advertising the nonexistent seminars.
* Six false testimonial letters from people who said they attended those sessions that never existed.
Huntley apparently directed all of the documents were to be falsified in a last-ditch effort to cover-up govt fraud.

L/E needs to determine whether to file (1) criminal tax fraud charges (2) for deliberately misstated income, (3) for filing falsified documents, and, (4) possibly failing to declare and pay taxes on "income interest."
COMMONLY USED PRACTICES TO FACILITATE GOVT FRAUD Falsifying govt documents incurs several felonies and might involve forgery. L/E might also employ Bank Secrecy Laws if bank accounts were used fraudulently.
REFERENCE Under the Bank Secrecy Act, banks are required to establish, implement and maintain programs designed to detect and report suspicious activity that might be indicative of govt fraud, money laundering and other financial crimes. The Bank Secrecy Act was enacted to protect the tax-paying public by identifying and detecting money laundering from criminal enterprises, govt fraud, tax evasion, money laudering and other unlawful activities. The investgations are monitored by the Internal Revenue Service's Criminal Investigation unit.
To cover their tracks, govt fraudsters might have created fake invoices that falsely show that govt money was being used for legitimate purposes, perhaps forged statements to cover the transfer of govt funds into secret bank accounts.
Govt fraud can also be facilitated by bank withdrawals, purchases on bank credits and intrabank transfers from legislative accounts into personal bank accounts.
A huge tipoff is whether bank withdrawals support luxurious lifestyle including payments for real estate, investment and stock holdings, jewelry, luxury vehicles, resort travel and gifts from luxury outlets for wives, mistresses, significant others. And large purchases of untraceable casino chips, and requests to wire transfer casino funds to bank accounts.
L/E is directed to get ahold of : (1) checks, (2) wire transfers, (3) account statements, (4) invoices, (5) bills, (6) delivery tickets, (7) correspondence including e-mail, contracts, loan agreements, (8) any other books or records, and (9) purchases of card cards witr large balances.
L/E should also explore govt monies paid to (a) stockbrokers, sub-brokers, (b) family members, (c) mortgage brokers, (d) financial managers, and, (e) real estate agents, brokers, and developers.
L/E should scrutinize bank accounts for suspicious activites: (A) large deposits, (B) funds transferred from one account into another, (C) request for withdrawals.
Bank records might also show diversions to secret LLC and other accounts, to operate personal businesses/law firms, and the like.there are bank accounts and checking accounts (also accounts with brokerages) from which deposits and withdrawals could be made.
<><><>WRT credit cards----those are frequently used to facilitate fraud......placing large sums of money on the card ostensibly for large purchases.......that are later turned into cash.

If the fraudsters are gamblers, they could have put stolen govt funds into untraceable casino chips which can be cashed-in anywhere in the world.
Casino bigwigs are happy to comply with L/E---b/c they fear losing valuable casino licenses. Casinos are wary of fraudulent activities----since it could put them in jeopardy. That's why they keep meticulous records. All of a high roller's gambling wins and losses are recorded on casino books.
Several ways to find out chip buys: (1) casinos have to submit financial records to state casino control commissions---the info would be there.
(2) L/E could ask how many casino chips were sold compared to how many actually were used for wagers.
Casinos record all their patrons' betting activities b/c some winners hide waging income from the IRS. Moreover, the casinos are protected if the bettors are crooks.
L/E is directed to investigate casino records for wire transfers, gambling wins (which may have been hidden and not declared to the IRS as income), gamblers' requesting deposits to secret LLC accounts...and the like.
Did the Huntley cabal make large contributions to religious entities? Did they make deals with religious entities? All "charitable" contributions to religous institutions and non-profit groups need rigorous scrutiny.
Religious and other non-profits are frequently-used vehicles for money laundering and tax evasion..... clergy take a cut then deposits the bulk in an offshore account for donors' use later...all tax free.
Some Central/South America banks will take large cash deposits and no one asks where it came from or if taxes were paid on it.
REFERENCE Dozens of "investments" were setup for Ponzi King Madoff by self-styled California "philanthropist" Stanley Chais. Later it was found the "philanthropist Chais" had collected a staggering $270 million between 1995-2008, and had been "donating" large sums to religious groups and other non-profits situated in friendly, accomodating Israel.

Govt fraud charges might include: (1) criminal tax fraud (2) deliberately misstating income, (3) filing false returns, (4) falsifying official govt documents, (5) intentionally mislabeling personal expenditures as business expenses, (6) utilizing govt funds inappropriately, (7) fraudulent use of govt funds for lavish personal expenditures, (8) fraudulently declaring to the IRS personal expenditures as legitimate business expenses.
