For people hoping Petraeus at Dept of Defense, he cannot be SecDef until Sept 1st 2021 due to the NSA of 1947.

I doubt that’s true, but, regardless, if we had the votes to pass him through the senate nomination process, then we’d almost certainly have the votes to amend any legislation that would prevent him from taking office. It’d take a weird set of circumstances to keep him from passing through one way or another.

Don’t want him for VEEP though. He’s not on record about most issues that we care about.

I support both provisions but I’ve always wondered if the provision that prevents former military from being SecDef until some years have passed and the law they passed after Kennedy made Bobby AG that prevents nepotistic appointments are constitutional.
