Man [illegal alien] Pleads Guilty to Murder at Albion WalMart

Used the "drunk illegal alien" defense:

In an hour-long plea Wednesday, Rodriguez-Flamenco first tried to convince the judge that he was drunk when he stabbed Byham to death.

"He stated to the court that he had been drinking prior to committing the murder. But in fact, he ran towards the victim before it was that he committed the murder. With one hand, he was attempting to steal her keys, and in the other hand he was flailing a knife at her, and then he fled on foot from the scene. So there was very little question if intoxication played a big role in this," said Joe Cardone, Orleans County District Attorney.

Even with the guilty plea, Rodriguez-Flamenco will receive no break on sentencing. He faces the maximum sentence of 25 years to life behind bars.

Kathleen Byham left Buffalo a decade ago to escape the crime and cruelty of urban life.

But a week ago today, in the rural community of Albion, a random act of violence more often associated with big cities claimed her life....
At about 7 p.m., she was walking to her Chevy Tracker — the treasured mini-SUV that Fox had helped her buy — when she was stabbed repeatedly by a migrant farm worker who was attempting to steal her vehicle, according to investigators.

another article: On the day Luis Rodriguez-Flamenco was arrested for the fatal stabbing of Kathleen Byham in the Albion Wal-Mart parking lot, he was out on bail in a neighboring town and on probation for a burglary conviction in another state. All the while, his status as an illegal alien had gone undetected.

I-Team 10 has begun looking at the circumstances that resulted in his being able to remain a free man on the day of the murder. In late August, Rodriguez-Flamenco was arrested in the village of media, accused of punching a 15-year-old girl in the face. Charged with misdemeanor assault and child endangerment, the town judge set his bail at $25,000 cash or $50,000 bond. That might have kept him behind bars.

But Rodriguez-Flamenco's public defender went to Orleans County Court Judge James Punch and successfully argued to have the bail reduced. Punch re-set bail at $2,000, which Rodriguez-Flamenco posted and he was set free....

I-Team 10 has learned that Rodriguez-Flamenco was employed at a farm in Albion working in the onion fields. He started work there just this year. The owner declined to speak on camera, but said that he was also given the same fake name and identification

Pfft. “25 to life” means he can be out in eight.

What does “no promise as to what his sentence will be” mean? What a joke but not funny.

It also means he can vote for Obama from jail.

Are they going to charge Congress and NY state govt as accessories since they allowed him to come here and live w/o any challenge?

The left is out there now, blaming objects for the murders in Aurora and seeking to steal away my Rights. Lone psychos do psycho things, impossible to prevent. But securing our borders, processing Illegal Aliens like the criminals they are would have prevented the murder of this woman and countless others caused by illegals that should not be allowed to roam our streets.

If you exclude those most likely to be productive and include those most likely to be parasites you cannot expect the country to thrive.

At least the LEGAL immigration from Mexico gives us good people willing to work hard and learn English but the rest of our immigration policy is completely against the good of the country.

He should be executed by firing squad on the very spot he stabbed the victim. All shots should be aimed at his face and he should be informed of such. The execution should be televised to the public and into the schools. His body should be tossed to the alligators.

Your post concerning illegal maggot magnets is right on. Question is: why are there so many Americans who don’t understand this??? I can’t conceive of a logical thought process that leads to anything good about attracting illegals into are country.....unless it is steeped in money and/or power accumulation. In which cases further thought should reveal that in the longer term, supporting illegal invaders is a losing strategy.

The other thing is something we ALL seem to fall into from time to time and that is to treat politics like a sports team.

If your team is doing it, it must be right. As liberals tend to live in a 5 second sound bite or bumper sticker world, their short attention span works against them as they never really think about what their side is saying.

It is very hard to sound bite Conservatism as it requires a sound understanding in the lessons of history as to what works, what fails, and the reason for both. Try doing that in 5 seconds.
