Walter E. Williams: States should nullify Obamacare

"On Rush Limbaugh’s Thursday program, George Mason University professor Walter E. Williams outlined the case that states can nullify Obamacare, citing Thomas Jefferson’s 1789 Kentucky Resolution, which was a claim that the U. S. Constitution is a compact among the several states, and any power not delegated to the U.S. government is void.

“I think the American citizens ought to press their state governors and legislatures just to nullify the law — just to plain nullify it and say, ‘The citizens of such-and-such-a state don’t have to obey Obamacare because it’s unconstitutional, regardless of what the Supreme Court says,’” Williams said.

Williams cited Marbury v. Madison, which said “all laws which are repugnant to the Constitution are null and void” to further the case for nullification from the states.

Nullification is a doctrine introduced in the infancy of the United States and was what some have suggested led to the Civil War. As far as the legal precedent of nullification and how it led to the Civil War, Williams said he doubted the repercussions would as serious as they were in 1861.

“I think two things are different this time,” he said. “First, most Americans are against Obamacare. And secondly, I don’t believe — and you call me up and tell me if I’m wrong about this — I don’t believe that you could find a United States soldier who would follow a presidential order to descend on a state to round up or shoot fellow Americans because they refuse to follow a congressional order to buy health insurance.”

That is certainly the situation today. No soldier would obey an order to shoot American citizens over an issue like this.

Will that be the way it is thirty years from now?

I dont anybody thirty years ago envisioned LEO’s shooting innocent civilians merely for being suspected criminal activity, but not confirmed.

So i honestly dont know if the military thirty years from now will have the same loyalty to the American people as they do now.

The Red States would; the Blue States wouldn't.

The States with a majority of Sex Deviates, Criminals, inner-city tribes, and illegals would want OTHERS to continue funding their lifestyles (aka; the Blue States).

The Red States, home of self-reliance, morallity, and common sense, would opt to be free of Government over-reach, and wealth redistribution.

The problem is that in the Red States, the large cities are infested with tribal parasites who are generating numbers of dependents who vote straight (D), and names are used for vote Fraud as a way of life.

The Red States would; the Blue States wouldn't. The ACA is remarkably, financially fragile. All it will take is 8-10 states to opt out and the whole thing collapses in on itself.

Scooby your comments refer to an election that goes against Obama and Harry Reid in the Senate, in order to stop Obamacare.

Nothing wrong with that, except what Walter Williams is saying is for states to pass laws against Obamacare and then stand by them. Just refuse to implement the law. And as many states as possible join together and do this.

I have advocated the same already, right here on FR. I cheered when I heard him say it.

Because the election by itself might not do it, depending on if our side gets all it wants or only part.

Also, the lame duck Obama even if he loses would try every conceivable trick to ram this down our throats or anything else he can ram down our throats before a new president was sworn in. Or might drag out a contested election and refuse to concede, even if he lost.

Or we might not do as well in the Senate as we think.

There’s voter fraud, and many people are worried because a foreign company will be involved with our vote counting, so I’ve read, anyway.

Something could go wrong with plans to stop it various other ways. That’s what I’m saying and Walter Williams must agree with me (heh heh) because he advocates the same thing,
NULLIFICATION BY STATES.

The fools on the Hill (Capitol Hill) were all counting on The Supremes to rule ObamaCare unconstitutional - thay way, they wouldn't have actually do any work on it. When Roberts went the other way, they gulped (which is why you heard McConnell bleat that "Repeal is unlikely" last week.

We can't count on Romney or Congress. I think nullification by states is our only chance.

It's the 10th Amendment and WE need to use it. It's more than Obamatax. Once states start realizing they don't have to lie back and take it from the Feds they can address a lot more dictates we're living under. Time for Americans to get an education on the Constitution. Capital Hill doesn't seem to get it. But then why should they. They think they're elite (and for one thing they will not lose their gold plated health care).

It was good to hear Dr. Williams again and a double treat with him and Dr. Sowell on together.

While a lot of Black people in this country may look at J Jackson and A Sharpton as fools you would be surprised how many have never heard of the 2 Drs, but then again I guess if they figure I like them, they must not be for ‘them’? <: <: <:

I don’t know what Congress and Romney will do.

McConnell has stated several things which are always lifted out of their context by media and jumped on by people here.

Bottom line is McConnell has said he will repeal it if he has the votes come January next year. Romney has sworn to repeal it. The House has already voted to repeal it but of course it can’t get anywhere beyond the House right now.

That doesn’t mean it will work out. I happen to believe they will repeal it if they can, but I go on the basis that we don’t know what OBAMA and CO. will do to fight like demons to impose it, including stealing an election or refusing to concede one, and we don’t know exactly how the election will turn out.

I believe state nullification is by far THE BEST WAY.

You say THE ONLY WAY.

Thank you for enlarging the issue to its ultimate.

Of course it’s more than Obamacare.

Even before Obamacare, the states were being treated like vassals of the Federal Government.

The states created the Feds, to be their servant, not the other way around.

We only disagree by degree. My confidence in Congress actually doing something to get rid of ObamaCare is near zero. They’re much more adept at kicking cans down the road and hoping someone else does the heavy lifting. They mostly vote on things for show. Now with Dr. Williams’ idea, their reaction will be “Oh good! Let the states take care of it - we can go back to making it look like we actually care about not raising the debt ceiling.”

Romney? Well, we’ll see.

This is the truth. This thing will require endless pits of cash to even keep the engine running. It’s like the RV that gets 2 miles to the gallon. A neat idea, but hardly practical. There likely isn’t enough cash in the world, EVER, to keep it going.

I had always regarded nullification as a closed issue, historically and philosophically interesting but left far behind on one of the many roads not taken.

But since we now have a president exercising nullification by executive whim — and so far getting away with it — maybe it’s time to revisit the question. I don’t see why Obama should get to the only one to pick and choose which laws to obey.

So suppose we have 5 states that “Nullify” forced ObeymeCare? Or say 10 states?

I’m trying to understand how that will play out. Will the Obamatons likely implement a pro-rated Obamacare with no revenues from those rebelling states and no care

At a minimum, it will greatly complicate the accounting for the Obamacare fascists to have some states in and some states out. But do you suppose if there are a large enough amount of states who nullify it that it could ultimately capsize Obamacare??? One can only hope.

I’m interested in anyone’s views on these scenarios. Thanks.
