There was an explanation given as to why he did that - wish I had saved the post.

If I’m understanding (the best I can remember), it was due to the court actually being divided 4 to 4, and if Roberts hadn’t switched sides, Arizona would have lost completely for some reason.

Even for a news anchor on a minor, insignificant cable network, Matthews is an outrageous buffoon. If MSNBC would dump him, they might pick up a few viewers, prisons, mental institutions, old folks homes, nothing that would justify big advertizing bucks, but better than broadcasting into empty space.

Hmm, I guess because Sotomayor recused herself, it could have been 4 to 4 with no majority. Then, the prior court ruling striking the whole thing down would stand?

Taney was appointed by Jackson. Earlier he had been Attorney General and Secretary of the Treasury under Jackson.

He was vilified mainly for the Dred Scott decision and for some of the reasoning in his decision, but the fact that he was a Catholic in a period of intense anti-Catholicism was probably an element in the hostility he faced. I think he was no longer a slaveholder at the time of the Dred Scott decision. He served through most of Lincoln's Presidency.

I have been saying that for weeks!

The Supreme Court has always been for taking away Peoples Rights, Hell in Dred Scott they declared him to be a Non-Person and Lets not forget the Legalization of Child Murder in Roe v. Wade.

The Supreme Court has never truly worked correctly, even since the days of the Founding. The people they are suppose to oversee Ignore them, Andrew Jackson told them to Piss off during the trail of tears. But they have supreme power over the citizenry (see the Dred Scott case above).

Thomas has too much genuine integrity not to say and Rush has too much genuine integrity that would prevent him from asking.

Without original intent, there are NO real limitations on what the federal government can do.

The problem for us it that R’s have also supported unconstitutional, big-government legislation for decades. And we continue to nominate candidates who do not believe in limited constitutional government nor their oath of office.

I agree, I think the left will con you with this do things our way and you’ll be a hero, don’t do things our way and you’ll be Roger Taney, etc. Roberts and Kennedy can be bought off in my opinion.
