Ginsberg, Kagan, and Breyer are lockstep fellow travelers with 0bama. Sotomayor, a fellow traveler just somewhat out of step occasionally. Roberts is a closet Statist.

It's tough to predict.

Based on the baby splitting of the AZ case, there's going to be all sorts of paper flying out on Thursday.

The logic may apply to Sotomayer, but I think Kagan and Ginsberg are in bed together.

I agree, the individual mandate should be struck down by 9-0 ruling, however it could come in as an 8-1 or 7-2 at best.

When your own attny can’t answer the simple brocolli question when appearing before the supreme court to argue your law, you have no chance that that provision will stand.

Kagan pushed for this health care package. There is no way she is going to vote it down. So that makes it at least 8-1.

But they are of similar mind. I will be delighted if the decision is unanimous, but I expect the hard leftists on the court to vote for their utopian wet dream.
