On Thursday, Iowa Republican Sen. Chuck Grassley ripped President Barack Obama for his assertion of the executive privilege to keep hiding Operation Fast and Furious documents from Congress. Grassley said the White House must provide a “privilege log” detailing what documents Obama is exercising his power over, and what his legal argument for doing so is. (Snip) “The attorney general repeatedly claimed that the Justice Department was making an ‘extraordinary offer’ Tuesday night,” Grassley continued. “The only thing extraordinary is that the attorney general offered a promise to produce documents one day and then asked the president to claim executive

CBS News has learned that the family of ICE Special Agent Jaime Zapata has filed a claim for wrongful death against the Justice Dept. and other federal agencies. Zapata was gunned down by suspected drug cartel members in Mexico in Feb. 2011 with weapons later linked to an ATF case in the Texas area. Joining the claim is Zapata's surviving partner in the attack: Victor Avila.

In an interview last November, Zapata's family told CBS News they feel that U.S. law enforcement could have stopped the sale of a gun used to kill their son. CBS News obtained law enforcement records that show the gun that killed Zapata came from the U.S.,

That is what I have read. But tonight Megan Kelly told the Bloviator, congress would have to file criminal charges first, and only after they are dismissed (which she said they would be) could they go to civil court.

Here what Mark Levin said about it yesterday...

Levin outlined what he believes is “the right way to proceed”:

1. Hold Holder in contempt by resolution of the House.

2.Seek authorization from the House for the Committee to proceed by civil action to compel production of the documents.

3.Chairman Issa should file suit in federal court in DC and seek expedited action.

4.A “privilege log” of all documents for which Executive Privilege is claimed should be sought by Issa and ordered produced immediately by the court.

5.The judge should promptly inspect all documents and then compel production of every document for which no legitimate reason justifies Executive Privilege.

There is no question in my mind that Holder planned on trying to get Issa to agree to drop the vote for a promise to (probably) produce some documents and then have Obama claim executive Privilege leaving Holder to explain that he was going to give them up but Obama over ruled him. Raspberry! These guys are always playing the angles.

That sounds as viable a theory as any. It wouldn`t surprise me in the least... without an EP play by Obama, Holder likely would have simply provided a slow, token flow of heavily redacted documents.
0bama must know the EP casts a negative light on him ... which tells me those documents in question have some hugely incriminating text. In the coming months, some worker bees are going to be putting in major overtime, shredding hard copies and deleting files. 0bama wants to get this in his rear-view mirror ASAP...problem for him is, Issa, Grassley and even Boehner won`t let him.
What I`m finding encouraging is..for the first time in recent memory.. the GOPers are smelling blood and are on the attack.
We all know how fleeting these random acts of bravery can be, so let`s call their offices and encourage them along.
