NEW YORK (AP) — A New York hospital worker and her spouse have filed a lawsuit saying spousal health benefits were denied to the same-sex couple.
The lawsuit filed Tuesday in federal court in Manhattan sought past and future health care benefits and a declaration that the Westchester County couple is entitled to the benefits.
The lawsuit's plaintiffs remained anonymous. Defendants included Empire Blue Cross Blue Shield and St. Joseph's Medical Center. Neither immediately responded to messages for comment. The lawsuit says one of the women works at St. Vincent's Westchester, a division of St. Joseph's. The women's attorney, Randolph McLaughlin, said the lawsuit was unique because it challenges the federal Defense of Marriage Act to obtain health care benefits.
A spokeswoman for Empire says the hospital cannot comment on pending litigation.

Surprise, surprise, surprise!
Homosexuals will not be happy until every Christian church and organization is bowing to their homo god! Any fool who thought otherwise has just drank a little too much of the Gay "Fool-Aid."
King Obama will dictate that the Church give them all free electric dildos with lifetime battery replacement at no cost.
He will make it clear - make no mistake.
It will be nothing more than social justice and will end equipment discrimination.
It’s the fair thing to do.
After all, it’s not their fault nature didn’t provide them the equipment of their choice.
The hospital needs to threaten to shutter it’s doors and then make a big stink about how lesbians hate the poor that it was serving.
And people in hell want ice water.
