Megyn Kelly Guest Alan Dershowitz Slams Zimmerman Prosecutor: Her Affidavit ‘Is A Crime’

Lawyer, professor and political commentator Alan Dershowitz stopped by America Live Wednesday afternoon, where he shared his thoughts on the George Zimmerman case with host Megyn Kelly. In a nutshell: He thinks the case has gone to hell in a widely-publicized handbasket. Specifically, he believes that, if anyone should be tried in this case, it should be Special Prosecutor Angela Corey.

“This affidavit,” he said, “submitted by the prosecutor in the Florida case is a crime. It’s a crime. If she in fact knew about ABC News’ pictures of the bloody head of Zimmerman and failed to include that in the affidavit, this affidavit is not the truth, the whole truth and nothing but the truth.”

He also took the prosecution to task for having used the passive voice — “a struggle ensued” — to describe the altercation that allegedly took place between Zimmerman and Trayvon Martin leading up to Trayvon’s death without adding pertinent evidence and details, such as whether Martin had been on top of Zimmerman, thus able to bash his head against the pavement as Zimmerman has claimed.

The prosecution’s goal, Dershowitz explained, is to present all the details and evidence of the case in order to pursue justice, not merely to seek justice solely for one side of the case. And “you don’t indite based on false information,” he told Kelly.

“Now, one of the problems,” he continued, “is because they’ve indited for second degree murder — and there’s nothing in this affidavit that suggests second degree murder, the elements of second degree murder aren’t here — the expectations have been reduced. There’s an article today in one of the… the Daily Beast saying “there’ll be riots in the street if there’s an acquittal.” If there are riots, it’s the prosecutor’s fault. Because she over-charged, raised expectations. No reasonable jury is going to convict based on the evidence I know of second degree murder. So this prosecutor not only may have suborned perjury, she may be responsible if there are going to be riots here for raising expectations to unreasonable levels.”

He reiterated that the case should focus on seeking justice, not necessarily on seeking “justice for Trayvon,” as the prosecutor has said. “Any reasonable judge,” he added, “would throw out second degree murder.”

So why might the prosecutor have “raised the stakes” to his level? Dershowitz has a theory:

She is a politically-elected person who was appointed to get Zimmerman. She was appointed to prevent riots. She wasn’t appointed to do justice; she was appointed to calm the situation down. That’s the problem when you elect prosecutors. We’re the only country in the western world that elects prosecutors. Prosecutors run for re-election based on how many people they put in jail. That doesn’t produce justice.

to make up, compose to give literary or formal expression to to put down in writing Maybe, because of the way the complaint was written, it was meant as "indite" because it was made up in literary fashion...

Woodward was guilty. The judge decided to let her out for whatever reason. She was convicted and should still be in prison. That has nothing to do with Zimmerman. Dershowitz is usually wrong although I agree with him in this case.

It is my hope that the ‘excitement’ in her life is just getting started. ;>)

I don’t think that Dershowitz is going to quit.

BTW, I rode my Harley through your state once on a cross country trip... it was so beautiful that I found it difficult to keep my eyes on the road.

Can’t believe they don’t have spell check. Even my BROWSER has spell check.

If your spell check is thorough, it wouldn't flag 'indite.' Indite is a word. It means to set out in writing.

Indict and indite are homophones - words that sound the same, but are spelled differently and have different meanings. Indict and indite are both legitimate words, and both are verbs, so spell check shouldn't have caught 'indite.'

Zimmerman’s arrest and murder charge is politically motivated - NOT criminal. The entire episode has been exhaustively reviewed by everyone from the Sanford police, the FDLE and the feds. There is simply no there, there.

Merriam Webster: INDITE. transitive verb. 1. a: make up, compose b: to give literary or formal expression to c: to put down in writing

Here's the other problem. US Attorneys are appointed and are arguably more political than elected prosecutors. At least I can vote Brian Mackie out of office if he oversteps his bounds.

No system is perfect, but I am starting to see some change and some balance going in the right direction. Nifong opened up a lot of eyes.

The whole “shaken baby syndrome” has since been proven to have no science behind it. Hundreds of people have been freed around the world.

The baby could have bumped it`s head as simple as that, at any rate she was innocent
