Texas wins latest round with EPA in federal court

SAN ANTONIO (AP) — A federal appeals court scolded the U.S. Environmental Protection Agency on Tuesday for rejecting a series of state pollution control projects in Texas that federal regulators said failed to satisfy requirements of the Clean Air Act.

The ruling from the 5th U.S. Circuit Court of Appeals stopped short of ordering the EPA to accept the previously rejected Texas measures. Yet the three-judge panel directed the agency to take another look at the state's regulations and issue a quick decision.

The judges did not set a deadline for when the EPA must approve or reject the Texas standards.

Big mistake in not to putting a deadline on the EPA!

In before the ‘we need to get rid of the EPA crowd’.

We need to change the Endangered Species Act, Clean Air Act, Clean Water Act, and a host of other legislation to give business and factual science a seat at the table, and quit allowing enviro groups to be the 4th branch of govt.

Just getting rid of the EPA means it just goes and embeds itself into a different part of govt.

I Would feel better if the EPA were dissolved and the states were free to set their own standards.

Thanks AAC. What I wonder is why when the courts reach rational and common sense decisions they are so.....nice about it??? Do they truly believe the committed fascists in the EPA politburo will see the error of their ways and immediately come to heel? Not likely so I have to wonder just what sort of stuff they're made of. When libtard judges make decisions based on their nanny state ideology they slap injunctions, temporary stays and cease and desist orders on their guileless prey.

Just like a boy named Sue, conservatives are going to have to get tough or die. JMHO of course...
