It isnt just Richard Cordray. Obama is also set to use recess appointments to install his picks to the National Labor Relations Board, according to White House officials and others familiar with ongoing discussions.
The move, which is arguably as impotant as the Cordray appointment, will ratchet up opposition from Republicans and make this an even bigger fight, since they have been attacking the NLRB regularly for its moves to streamline union elections and inform workers of their rights.
Obama is set to appoint Sharon Block, Terence Flynn, and Richard Griffin to the board something unions have made a big priority for them in the new year. Senate Republicans have opposed the recess appointments to the NLRB on constitutional grounds, but unions charge that Republicans are only interested in rendering the agency inoperative.

There were no impeachment hearings and the national media did not scream.

The Senate is not in recess; therefore, these appointments are blatantly unconstitutional.

The Senate was actually in recess for President Bush. This is not the case for Mr. Obama.

The fight over these appointments is that the Republicans claim the Senate is NOT in recess. They have apparently refused to allow the Senate to go into formal recess precisely to block these sorts of appointments.

Republican presidents have done the exact same thing in the past and no media was up in arms and it was not illegal.
However, it is an overreach of Executive Power when it is done by a Democratic president or a Republican president.
But, if you were to review threads concerning Bush’s Recess Appointments, you would find overwhelming approval except for a few of us true conservatives who are willing to condemn any president who uses such powers.
These aren’t recess appointments Sherlock. The Senate is NOT in recess.
Also, local and state governments should not acknowledge the authority of these individuals and the board that they are on since they were placed on it illegally.

would actually change the NLRB that Obama has constructed.
Would they get rid of it ? Insert some real conservatives there ? Downsize it ? Hire more people ? Outsource to contractors and grow it anyway ?

The Senate was in a Pro Forma session devised by the new Dem Majorities. You know nancy, harry and that new senator from ill.
Congress was in recess when Bush made those appts. That is NOT the case today.
If the Senate is in session, the Republicans can block nominations, even if the sessions lasts 12 seconds as the Democrats did on 2007 to block Bush nominees.
