Another Headache For DSK: Accuser Files Civil Suit

It isn’t exactly surprising news, but it is news nonetheless: The hotel maid who was allegedly assaulted by former International Monetary Fund chief Dominique Strauss-Kahn on Monday filed a long-awaited civil suit against “DSK,” accusing him of a “violent and sadistic” sexual attack that has done her permanent damage. The lawsuit by Nafissatou Diallo comes on the heels of her decision to speak publicly in media interviews and at a news conference about the alleged attack by Strauss-Kahn after she entered his suite on May 14.  Prosecutors with the Manhattan District Attorney’s office are still investigating whether to pursue or drop a seven-count criminal indictment against the man once seen as French presidential contender.

Mr. Strauss-Kahn’s next scheduled court date is Aug. 23. Prosecutors declined to comment on Monday.

If there is any place on this planet where DSK does not want to face a trial by Jury, it is in the Bronx.    Bronx juries are known for their very generous damages awards to  plaintiffs. Most Criminal law experts, especially the old timers say this definitely means DA Vance is planning on dropping the Criminal charges.   Of course, that means IMHO he will be former Manhattan DA Vance come next election time.

If the charge is actually dropped, this not really a good news for French socialist politicians who lined up to replace DSK. The king who is supposed to have been captured and killed is returning alive. He is not exactly in a good mood, either.

I’m having a hard time sympathizing with either. Given the make up of any Bronx jury, she is surely favored, but wouldn’t he have an appeal to a state court??? Seems if the prosecutors aren’t even sure they will file suit, her case is not that strong. And I “get” that that would be irrelevant to a Bronx jur.

The civil case is filed in NY State Supreme Court. If DSK is foolish enough to not settle & goes to trial and he loses , he can appeal it to the Appellate Division. Most likely DSK will try to get it out of the Bronx, and into Federal Court on the grounds he is a foreign national.

MAID FILES CIVIL SUIT AGAINST EX IMF CHIEF DSK IN THE BRONX SUPREME COURT

TWO LEGAL OPINIONS ON DSK CIVIL SUIT:

Veteran defense lawyer Gerald Shargel, who’s not involved in the Strauss-Kahn case, said some lawyers delay filing a civil lawsuit to deprive the defense in a criminal trial from asking witnesses questions about the civil suit. But he added that he has found that the majority of lawyers file civil suits in sexual-assault cases before criminal trials.

“It may have some effect on the jury’s verdict, but it rarely decides the outcome,” he said.

An Annapolis, Md., defense lawyer who specializes in sexual abuse cases, Tom A. Pavlinic, said Diallo put her credibility at risk by bringing the civil lawsuit.

“She has done him a favor,” Pavlinic said. “Prosecutors, in my experience, don’t like when complainants in criminal cases initiate litigation in a civil case.”

The Manhattan district attorney’s office declined to comment on the filing of the lawsuit.
