NFU Says Farm Equipment Should be Exempt from CDL Requirements
Hoosier Ag Today ^ | July 29th

National Farmers Union (NFU) submitted comments to Thomas Yager of the Federal Motor Carrier Safety Administration (FMCSA) about a possible reinterpretation of the Motor Carrier Act of 1935, the Motor Carrier Safety Act of 1984, and the Commercial Motor Vehicle Safety Act of 1986. The FMCSA is exploring the possibility of categorizing "implements of husbandry and other farm equipment" as commercial motor vehicles, thus requiring a commercial driver's license (CDL) to operate. "Most farmers have little, if any, control or knowledge of the final destination of the commodities they produce," said NFU President Roger Johnson. "As such, it is inappropriate to consider a farmer's commodity delivery to a grain handling facility, for one example, within the state as interstate commerce. Deeming this sort of commodity delivery as interstate commerce and subjecting the farmer to additional levels of regulation is an overly burdensome interpretation of statute. NFU asks that a more reasonable approach be found."

The regulatory burdens on all of our lives continues.

A lot is being made of this regulation in conservative media. This is how the locals look at it.

Not a chance. The courts have already ruled that raising grain on your own land to feed your own chickens is “interstate trade”...

Am I interpreting this correctly? They are wanting to require a CDL for someone to operate ‘farm equipment’?!?!?!

That would be insane, and would bring an incredible hardship on every small/family type farm!

You already need a hazmat endorsement and an FBI background check to haul hazmat.

To haul corn across your own farm?

Whatever the motive - stupidity, malice, incompetence - these creatures won't stop doing these things to us until they're absolutely forced to.

Yeah, for ‘hazardous materials’ such as beef.

(let’s be honest, the environmentalists and PETA crowd have likely already thought of this angle)

Milk is no different than petroleum in the eyes of the EPA.

The National Farmers Union is an old leftist organization, now reaping what they sowed.

What about mowing crews? They are operating for profit. Will people running mowers have to have CDLs?

And the winner of the latest Stupid Contest: FMCSA. You can’t make up stuff this stupid ... it takes government administrators.
