If he is incompetent, then he should be sequestered with the criminally insane until such time that he is competent to stand trial. But in either case, he should not be allowed to roam free until there has been a jury verdict.

You’re missing the point. If he was found competent, then he’d be subject to the Death Penalty..and that is a debate Dems/libs want to avoid at all costs..

Agreed. They need to make allowances in the law for a “guilty by reason of insanity” and the sentence for it is institutionalization.

From the CBS News website:

Federal mental health experts will not be gauging whether Loughner is sane, or what his mental state was at the time of the shooting; but as to whether he understands the charges against him and if he can help his attorney's in his defense.

Note the use of the apostrophe in what is clearly the plural, as opposed to the posessive, sense of the word "attorneys."

This is CBS News. The Tiffany Network. Chock top to bottom with Ivy League hotshots.

If I recall correctly, Arizona, unlike many states, has a different system for insanity pleas. If you are insane, you are remanded to a nuthouse. If at any point you are judged sane, you would then be remanded for trial for your crime. I kind of remember hearing this about AZ at the time this first happened, because of the likelihood of an insanity plea, and they made much of the fact that AZ has closed the loophole that lets criminals off when they are adjudged insane.

Quite a reasonable hypothesis. No need for a grand conspiracy, just whispers in a few of the right ears that important people would be displeased to hear Loughner's thoughts make it into the primary media. If it got to trial, even the MSM couldn't refuse to cover it.

If they thought the first words out of his mouth would be "Sarah made me do it", he'd be competent, trial starts next week.

Also if he was found sane then the gun control crowd couldn’t use him as an excuse to tighten control either.

If declared insane he is the poster child for why they want to have doctors records open for scrutiny during background checks, if he isn’t insane then he is just another murderer like any other and not as useful a propaganda talking point.

In AZ it is ‘Guilty, but insane’. Sentence includes time at 24th and Van Buren (state looney bin).
