Yes, we could make p3nises illegal - and THAT day is probably not far off, given present government trends - but, then, when p3nises are outlawed, only outlaws will have p3nises.
And let’s keep in mind that the authority to have a p3nis is NOT protected in the Bill of Rights - although we might with some merit argue that the establishment of congress is tantamount to the same thing, multiplied many times over.
