Breaking News: Obama action against DOMA coming

A well-placed and trusted source tells me that, any minute now, Attorney General Eric Holder will issue a statement announcing that it will no longer defend so-called Defense of Marriage Act lawsuits in court. The source believes DOJ had come to the conclusion that heightened scrutiny would apply, and that these cases cannot be defended in court. A 530d letter has been sent to Congress informing it that, if it wants to defend the statute, it is free to do so. A case is pending now that has a filing deadline of March 11.

This is huge, folks. By definitively stating that gay men and lesbians deserve heightened scrutiny, the Obama administration is declaring that there is no government interest in perpetuating the discrimination aggrieved parties are trying to redress.

What this means is that if you don’t like a law, file a lawsuit and then the government LETS YOU WIN.

I know the liberal view is that marriage discriminates, yadda, yadda, yadda. And that to them, it’s a minor technical change to say marriage should be just any two people, etc.

But, doesn’t all of this really call into question whether government or society is allowed to define marriage at all?
Even defining marriage as any two people discriminates against polygamy and group marriage.

I think that since they are forcing homosexual marriage through the courts, it does call into question whether any definition of marriage will be allowed to stand.

And who will key targets of future lawsuits be? Churches, because there is no mainstream religious organization which performs homosexual marriages. Will they be sued? I guess we’ll find out.

This is also huge: during the DADT repeal training last Friday, my boss and I were discussing that this is the one area in which, even after repeal of DADT, homosexuals in the military won’t be treated equally: “partner” benefits and military family housing.

A calculated and deliberate attempt to tear down the last piece of the wall that separates aberrant behavior from natural relationships. Just disgusting.

"Furthermore, pursuant to the President’s instructions, and upon further notification to Congress, I will instruct Department attorneys to advise courts in other pending DOMA litigation of the President’s and my conclusions that a heightened standard should apply, that Section 3 is unconstitutional under that standard and that the Department will cease defense of Section 3."

Yippee. The Executive Branch now decides what's constitutional.

I always thought it interesting but our minister does not perform any wedding ceremonies. Apparently it was an issue of many of his emails so he simply announced from the pulpit some time ago that he “chose not to”. Guess that is one way to get around it.

Excerpt: "After careful consideration, including review of a recommendation from me, the President of the United States has made the determination that Section 3 of the Defense of Marriage Act (“DOMA”), 1 U.S.C. § 7, as applied to same-sex couples who are legally married under state law, violates the equal protection component of the Fifth Amendment. Pursuant to 28 U.S.C. § 530D, I am writing to advise you of the Executive Branch’s determination and to inform you of the steps the Department will take in two pending DOMA cases to implement that determination."

As you know, the Department has a longstanding practice of defending the constitutionality of duly-enacted statutes if reasonable arguments can be made in their defense, a practice that accords the respect appropriately due to a coequal branch of government. However, the Department in the past has declined to defend statutes despite the availability of professionally responsible arguments, in part because the Department does not consider every plausible argument to be a “reasonable” one. “[D]ifferent cases can raise very different issues with respect to statutes of doubtful constitutional validity,” and thus there are “a variety of factors that bear on whether the Department will defend the constitutionality of a statute.” Letter to Hon. Orrin G. Hatch from Assistant Attorney General Andrew Fois at 7 (Mar. 22, 1996). This is the rare case where the proper course is to forgo the defense of this statute. Moreover, the Department has declined to defend a statute “in cases in which it is manifest that the President has concluded that the statute is unconstitutional,” as is the case here. Seth P. Waxman, Defending Congress, 79 N.C. L.Rev. 1073, 1083 (2001). In light of the foregoing, I will instruct the Department’s lawyers to immediately inform the district courts in Windsor and Pedersen of the Executive Branch’s view that heightened scrutiny is the appropriate standard of review and that, consistent with that standard, Section 3 of DOMA may not be constitutionally applied to same-sex couples whose marriages are legally recognized under state law.

FRiend, that day is coming... Speaking out against homosexuality is already equated to racial hate speech. Hell, you might as well be wearing KKK regalia and standing in front of a burning cross if you say homosexuality is a sin.

Churches will soon be sued for discriminating against homosexuals. Pedophiles and zoophiles are wringing their hands with glee because they know it is only a short time before they too are considered "normal" and their evil acts given societal protection.

In 1973, the American Psychiatric Association (APA) declared that homosexuality was not a disease simply by changing the 81-word definition of sexual deviance in its own reference manual.

In July 1998, the APA’s Psychological Bulletin published an article that seemed to condone pedophilia. “A Meta-Analytic Examination of Assumed Properties of Child Sexual Abuse Using College Samples” argued that the “negative potential” of sexual abuse has “been overstated.” Child sex abuse, they contended, actually encompasses a wide range of behavior best described with “value neutral” terms.

Less than 50 years ago, nobody would have believed that homosexuality would be so openly embraced as it is today. Nor would anyone today believe that other deviant and evil behavior will be openly embraced in the future.

I’m only 35 however I firmly believe that America peaked as a nation in the 50’s. It’s been all downhill and will continue to be downhill from there...

The DOMA is a Federal LAW passed by CONGRESS and signed into LAW by Bubba CLINTON.

OBAMA has just STATED he is REFUSING to enforce FEDERAL LAW.

WE don’t get to pick and choose WHICH LAWS we will follow...AND THAT GOES FOR THE PRESIDENT ALSO.

THIS IS AN IMPEACHABLE OFFENSE.

It’s been said oil at $120 to $140 will crash the whole system...not far from that now. Even at $120 our nation will shake from it. We are heading for some very dire times ahead.
