This is the correct and constitutional course of action Thomas Woods argues in his book “Nullification.”

If the federal government trounces Nullification, they will be, at that point, insisting that the people go Cairo on them.

Marbury v. Madison was decided in 1803. Many of the founding fathers were still alive and kicking. They took no action to imply that the implications of this decision were not what they intended. This is the system they gave us.

Mostly agree. JMO but, Americans have generally become more, uh, subdued in our reaction to life's twists and turns. Even so, I don't believe that is the problem; falling asleep at the switch was our downfall. We had it all. We became fat, dumb and happy to the point many came to believe it would last forever -- without minding the store. Complacency is an insidious condition that I'm afraid is a natural foible of Man when things are going well. Anyhow, the real question is, how much more will we tolerate before we realize our nation and our way of life is at the brink? I honestly don't know the answer to that. Are Americans truly special or did we just get lucky for a while?

M vs M established the concept of judicial review under a statist chief justice from the Hamiltonian school of "national" government advocacy. What else did it do?

You submit there was no blowback on the decision. Did you pull that out of thin air or can you to prove it. Not that it really matters in this instance, the decision didn't speak to the role of the states anyway - nothing. In any event, you're falling back on what I believe is a misguided notion of judicial inerrancy. That's just nonsense IMO. A position that essentially says the creators of the feral government have NO voice in its operation.

Good discussion if you're willing to question your notion of judicial infallibility: The Marbury v. Madison Mantra.

I think you’re right. The Feds will be asking for it, but that doesn’t mean it will come.

Only when entertainment is shut down and the food lines start and people can’t put gas in their tanks. Maybe.

“”the 1958 U.S. Supreme Court decision reaffirming that federal laws “shall be the supreme law of the land.”

To an average Joe like myself, that decision appears to violate the 10th amendment. I’d be interested to read a piece on that decision written by a real Constitutional scholar.”

No kidding that the ruling violates the 2nd amendment, as well as the very clause in question which specifies only laws in pursuance to the Federal Constitution.

As for looking for a Constitutional scholar be very picky who you choose a lot of self-professed Constitutional scholars think the literal wording of the Constitution as understood and agreed upon by the 13 states means nothing.

They would be right if the Federal government is also right in it’s assertion that their own hand picked employees have the final word on the meaning of the Federal Constitution.

Long overdue that the States started telling the federal government what it can do with its belief that its authority under the Commerce Clause is infinite. This is also a shot across the Supreme Court’s bow. These States are telling the Justices that a ruling upholding ObamaCare, especially the Individual Mandate, will be ignored.

Got that right. The feral triumvirate has had its way with the people and the states for far too long. I pray that We the People have the staying power we'll need to tame the beast. Our states will also need our encouragement to gather the will to stand with us.

These States are telling the Justices that a ruling upholding ObamaCare, especially the Individual Mandate, will be ignored.

I hope so. Someone's gonna blink. I hope it's not our side.

I still like the idea of making it a felony to enforce provisions of zerocare on a state's citizen. Arrest and charge anyone attempting to enforce Zerocare. If they send in the feds, the county sheriff can arrest them too.
