Sen. Jim DeMint, R-SC, says Federal Communications Commission should be renamed the "Fabricating a Crisis Commission," following a vote by the panel's three Democrats to approve proposed rules that amount to a hostile takeover of the Internet by a government agency acting illegally.
The proposal - misleadingly described by proponents as an attempt to insure "net neutrality" by guaranteeing equal access to the Internet - was introduced a year ago by Julius Genachowski, President Obama's appointee as FCC chairman.
A federal court has ruled that the commission has no authority to regulate the Internet, and a bipartisan group of senators and representives warned Genechowski not to attempt to impose a regulatory regime on the Internet earlier this year.

Monsanto’s food bill passed unanimously. Can you imagine owning the vote of all 100 senators? Now we know who really runs the world.
That’s why I think the only thing the HOR should do is pass a resolution declaring that the FCC overreached their authority and violated a Supreme court ruling.
Attempting to “Reverse” the decision of the FCC acknowledges their authority to do it in the first place.
In the long run, that could turn out worse than the FCC vote.
These are the ways of the commies and facists. DeMint needs some reinforcements in the Senate to push the pendulum back against liberalism.
I hope we can do a better job of this than we did with the START treaty.
What exactly do you percieve net nuetrality to be? I thought it was just keeping the internet the way it is now. So my ISP can’t charge me extra for sites like freerepublic.
He is also correct that this takeover is unlawful. You cannot repeal that which isn’t law, but you can go after the agency that is acting outside of the law.
I am going to mark this day, Dec. 21st to make sure DeMint gets credit for getting it right.
"Prosecution" is a term that's not limited to governmental bodies.

Welcome to Free Republic. First problem with the FCC’s adoption of net neutrality is the fact they have no authority to pass or iplement their rules, i.e., it’s unconstitutional. The Supreme Court has explicitly stated the FCC may not assume legal authority to implement net neutrailty and Congress has also refused to grant them the authority to do so.

I didn’t know the internet was broken!!! Can’t have something that works, can we? What kind of people wake up in the morning looking for ways to screw things up for the rest of us?

That was the intent when they first started talking about it about 5-6 years ago. But it morphed into emergency powers to regulate internet security, and then into regulation of content itself over the last couple of years.
Basically, it is the same old playbook they use to play corporate favorites under the guise of regulation. You know, laws are only for the little guys and not the big fish in the pond or political donors with big pockets. And I think Obama’s going to need the deepest pockets he can find in 2012 in order to have a chance in addition to being able to shut down his oppositions’ mass communications.
