Rahm Doesn't Live Here Anymore

One wonders why the penny wise and pound foolish Rahm did not simply maintain a pied-a-terre inside of the city for the past year and half? He could have easily afforded to do so. Emanuel has had a history of sticking his foot in it when it comes to housing matters. While in Congress, the thrifty Emanuel lived in a basement apartment in the home of Connecticut Democratic representative Rosa DeLauro. The problem was it was an illegal basement apartment in a single family home that violated District of Columbia zoning laws. When the story was publicized, Emanuel was ridiculed as a “cheapskate” in the media.

By failing to maintain a legal residence in Chicago for the past year, Emanuel has rendered himself ineligible to run for mayor in 2011.

I think most residency laws have not been able to withstand legal challenge over the past 30 or 40 years.

Or in other words...if Obama can be President without being a U.S. Citizen then Rahm can be Mayor for temporarily moving out of his home, while still voting in Chicago, to serve at the request of the President.

New York has extremely lax residency rules for its candidates. That difference is part of federalism and state sovereignty.

The Illinois residency laws have previously been upheld in court as not unduly burdensome and as being related to a rational policy purpose.

The residency requirements for municipal officers are not especially recent. The policy is almost a century and a half old. Emanuel did not trouble himself to read the Election Code.

Rahm's legal camp maintains that another section of the Chicago election code states that residency requirement don't apply if the potential candidate was hired or appointed to an out-of-state federal position.

Looks like Emanuel will win this round.

The exemption being distorted by the press relations flack was designed to benefit soldiers on active duty in the US military. The statutory language is clear on that point.

It is a real stretch to suggest that Rahm’s service in the White House was the equivalent of serving in combat.

Eligibility in Chicago is whatever a Democrat judge says it is. The ruling class wants Emanuel and they will get him and that's that.

Here's the relevant law: (65 ILCS 5/3.1‑10‑5) (from Ch. 24, par. 3.1‑10‑5) Sec. 3.1‑10‑5. Qualifications; elective office. (a) A person is not eligible for an elective municipal office unless that person is a qualified elector of the municipality and has resided in the municipality at least one year next preceding the election or appointment, except as provided in subsection (c) of Section 3.1‑20‑25, subsection (b) of Section 3.1‑25‑75, Section 5‑2‑2, or Section 5‑2‑11. (b) A person is not eligible for an elective municipal office if that person is in arrears in the payment of a tax or other indebtedness due to the municipality or has been convicted in any court located in the United States of any infamous crime, bribery, perjury, or other felony. (c) A person is not eligible for the office of alderman of a ward unless that person has resided in the ward that the person seeks to represent, and a person is not eligible for the office of trustee of a district unless that person has resided in the municipality, at least one year next preceding the election or appointment, except as provided in subsection (c) of Section 3.1‑20‑25, subsection (b) of Section 3.1‑25‑75, Section 5‑2‑2, or Section 5‑2‑11. (d) If a person (i) is a resident of a municipality immediately prior to the active duty military service of that person or that person's spouse, (ii) resides anywhere outside of the municipality during that active duty military service, and (iii) immediately upon completion of that active duty military service is again a resident of the municipality, then the time during which the person resides outside the municipality during the active duty military service is deemed to be time during which the person is a resident of the municipality for purposes of determining the residency requirement under subsection (a). Ohh i’d say Rahm is not in Obama’s good books and Obama will stick it to him, he wants a black mayor of chicago. Watch this one, may just run and run.

The defensive statements issued by Rahm's attorneys are what they are. I maintain that he probably will win the residency battle.

He's a sharp guy that wouldn't have left D. C. to throw his hat into the mayoral ring so confidently if he and the best lawyers in the land hadn't checked things out way beforehand.

If a residency battle boils down to the Chicago Way versus the legal way versus the Rahm way, folks will learn they're all one and the same in this neck of the woods.

With several prominent black candidates in the race, including Carol Mostly Fraud, Rahm is banking on the black vote to split wide open, creating a wide-enough aperature for him to ooze through.

Remember, folks, there is no primary here....it's a one-and-only popular vote election. It's also non-partisan.....with no party affiliation listed beside the candidate's name.

It's a free-for-all with a huge list of names already filed to be on the final ballot.

In the event that no candidate receives more than 50% + 1 of the vote there is a run-off election in April between the two top candidates..

The election is February 22, 2011.

Rules are made for other people. Not folks who will flaunt the law like Emanuel, Lautenberg, Franken, Reid, Rangel among many other Dems. Laws exist for a reason and they should apply equally to all, not to a select few.
