Kirk to miss part of lame-duck session

November 6, 2010 (SPRINGFIELD, Ill.) -- Illinois Republican Mark Kirk won't be seated in the U.S. Senate in time for the start of the lame duck session of Congress this month -- unlike two other newly elected senators.

The session begins Nov. 15. But state officials say the paperwork officially declaring Kirk the winner of the Senate race won't be delivered until Nov. 29.

That should still allow Kirk to participate in two weeks of the session in December. He argued strongly during the campaign that voters needed to send him to the Senate quickly so he could help block spending and tax increases.

Two Democrats are expected to be sworn in at the start of the lame duck session. Chris Coons of Delaware will fill the remainder of Vice President Joe Biden's term, and Joe Manchin of West Virginia replaces the late Robert Byrd.

GOP should go ballistic and tout this everywhere (including cable TV) as an evidence of abuse of power, illegal obstruction of election result etc.

GOP should also file lawsuits to force dems to do this.

Of course, we all know this is not going to happen. GOP is not saying anything.

Way to disenfranchise the Illinois voters, Democrats. But then I guess that’s what they specialize in.

Kirk is just a RAT with an “R” by his name.

You can complain all you want about Kirk being a RINO but he has always been strong on the issue of the Bush tax cuts and that is one of the big issues that will be brought up in the lame duck session. Believe me, we want Kirk in there for that vote.

Gee, all that endless talk during the campaign about we "had to" elect Kirk because he would "stop Obama" during the lame-duck session, and now it turns out he won't even be in the Senate for most of it. And funny how lukewarm the GOP was about helping the other two Republicans running in special elections -- Christine O'Donnell of DE, and John Raese of WV, if it was such a "huge priority" to ensure the RATs wouldn't pass any bad stuff before January.

Another Kirk campaign talking point that got us nowhere. Like all the stuff about how he'd "oppose activist judges" and "lead the fight against Obamacare". Which one will be next? I bet Kirk helps draft a "new" version of cap n' trade and uses the excuse that he would have voted against the "original bill" from the House but this "new" version is "thoughtful and bipartisan" so he's not breaking his campaign promise.

My guess is this little arragement to keep Roland Burris in for the lame-duck session to vote the "right" way was decided during Kirk's little closed-door "beer summit" with his pal Alexi. Kirk had to make some concessions since Alexi "took one for the team"

And some freepers still don't get it. "Kirk might not be such of a RINO in the Senate, let's wait and see and give him a chance" "Brady lost and Kirk won because Brady was too socially conservative and Quinn painted him as anti-woman".

The polling numbers for months are completely at odds with the election results. There's no way Kirk got more votes in suburban Crook when he didn't even campaign there while Brady stumped here endlessly. The numbers in Crook county were fixed. Kirk is in the Senate because the Chicago machine WANTED him there. He takes his marching orders from them.

Any of the Kirk apologists out there who want to prove me wrong, go ahead. Let me know when Obama starts quaking in his boots that the big bad "fiscal conservative" has arrived to "stop him"

I found another article with additional explanation:

The process of officially declaring Kirk the winner and transmitting that information to Washington has several steps.

First, local election authorities finish counting votes and send the results to the State Board of Elections. The deadline for that is Nov. 19, said David Druker, spokesman for Illinois Secretary of State Jesse White. On Nov. 23, the Board of Elections meets to officially certify the winner.

After that, White and Gov. Pat Quinn sign a form notifying the U.S. Senate that Kirk has been elected. The paperwork then goes to the Senate, which next meets on Nov. 29.

I'd be interested to know if all of these dates/deadlines are set by law, or if this is just typical Chicago dem obstructionism.
