Ban on guns in parks before 9th Circuit Court of Appeals(CA)

The cities of Redondo Beach and Hermosa Beach ban the possession of guns in parks. The Redondo Beach ordinance was passed this May. The Hermosa Beach ordinance seems to date back to the 1990s. These are the only two cities in the South Bay of Los Angeles which restrict the possession of firearms in parks. The City of Hermosa Beach claims its beach is a park and as such, is the only public beach in the County of Los Angeles where the possession of firearms is prohibited. The old railroad tracks which were converted into green space a couple of decades ago, cuts through the city like a Berlin wall where carrying a firearm is prohibited by the City, for now.

The Ninth Circuit Court of Appeals just heard oral arguments in the Nordyke v King case. This particular case has been winding its way through the courts for eleven years. Last year, the three judge panel ruled against the Nordykes but that decision was vacated by the full eleven judge Court in an en banc hearing. It was remanded back to the three judge panel so that the plaintiffs could argue their case pursuant to the United States Supreme Court decisions in Heller and McDonald. Heller declared that we have a right to carry a weapon for the purpose of self-defense, McDonald held that States and local governments must respect that right.

Nobody has a crystal ball which can predict how the 9th Circuit Court will rule. The Court seemed eager to send the case back to trial but neither of the attorneys representing the two parties in the case believe that is necessary to do so, and both stated that the Court has sufficient information before it to rule on the case.
