Just like Roe v.Wade, gay marriage is coming to the U.S. whether the majority likes it or not. And just like abortion, because the citizens have no “say” in the matter, there will be blood.
I think they are hedging their bets.
The stay means no rush or negative consequence FOR THE JUDGES.
Walker was being humiliated in the media.
unlike Roe that was an INDIVIDUAL issue.
This is not individual.
It all hinges on what these judges do at ABA conferences and who they hang out with.
we need to know the judges and their personal affiliations.

I agree with you as to motive, but I just wonder if they shot themselves in their collective foot and won’t actually be able to use the argument they’d like to, because they’ve already rendered it moot.
It is absolutely pathetic that this is even a question. I do find it interesting that the Ninth Circuit has actually made some relatively good decisions here and there in the last couple of years. Did some of the justices get replaced? Time to go look that up.

1. So, for all the lawyers among us, if you all know of any, HOW will this 9th court rule on standing, what should they rule on standing, and why would those appealing bother if they knew that they’d just get thrown out because of standing.
2. However, since the 1st amendment permits the people to petition their government for redress of grievance, can the people of California petition directly to the Scotus? How many petitioners would it take to get their attention/be legal?
I would think the appeals court is going to have to give that some weight.
Otherwise it becomes absurdly easy for the Governor and Attorney General of California to collude with an initiative’s opponents to void an initiative by a half -hearted defense in court and then refusing to appeal the decision.
The ramifications of that go well beyond gay marriage...
