There are already civil agencies designated for the task of dealing with illegal immigration. Use of the military is explicitly illegal according to USC 18, Sect. 1385:

Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army or the Air Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both.

That's just the law, son, and it's been on the books for a long, long time. Go ahead and try to get it changed ... but until then, Palin's idea is illegal.

The president at his descretion can use the National Guard or any other military force to defend against overwhelming threats to our National Security both at the border and even internally.

What a president can't do is use the military force for standard law enforcement tasks, a.k.a domestic police work.

Police functions and national security functions are two different things. You are ignoring the differences.

What Palin proposed IS legal.
