Author of Arizona Immigration Law Wants To End Birthright Citizenship

The author of Arizona's immigration law, state Sen. Russell Pearce, told constituents he wants to pass another measure to invalidate citizenship granted to the children of illegal aliens. Pearce wrote that he plans to "push for an Arizona bill that would refuse to accept or issue a birth certificate that recognizes citizenship to those born to illegal aliens, unless one parent is a citizen," in an email obtained by Phoenix CBS affiliate KPHO.

Pearce also forwarded an email from another correspondent expanding on the proposal — which he later told KPHO he didn't agree with. "If we are going to have an effect on the anchor baby racket, we need to target the mother. Call it sexist, but that's the way nature made it. Men don't drop anchor babies, illegal alien mothers do," the email said. Pearce did tell the CBS affiliate, however, that he didn't see anything wrong with using the term "anchor baby" to refer to natural-born U.S. citizens.

Last year, 92 Congressmen sponsored a bill that would change the 14th Amendment so that children of illegal aliens born in the United States would not be granted citizenship. The bill is still in committee. Last month, Rep. Duncan Hunter of California told a tea party rally he would support deporting children of illegal aliens, even if they are citizens.

Hear, hear!

The words “...and subject to their jurisdiction,...” is the centerpiece of this debate.

Citizens and naturalized aliens ARE subject to the jurisdiction and laws of the United States. Those who crossed the border in the dark and hide from ICE and Border Patrol vehicles are NOT subject to our jurisdiction. They run! Heck, they don’t live under ANY jurisdiction!

Therefore, the children of those not subject to U.S. jurisdiction, despite their being born within the boundaries of the United States, are NOT instant citizens. Feel no guilt about denying citizenship to those who aren’t qualified to receive it.

The 14th Amendment (ratified in 1868, soon after the Civil War) was adopted to ensure the citizenship of ex-slaves and their families. Read the Amendment again with that in mind.

My non-lawyer understanding is that the Supremes can't make “advisory opinions” or in other words opinions on requrest on matters that are not the result of a genuine cause or controversy brought by one party against another.

If AZ were to pass such an anti-anchor baby statute it would almost surely provoke a genuine case that could reach the Supremes.

Yeah but apparently what the GOP didn’t know then was that when your the party in power you can trample the constitution into the ground to get whatever you want done and screw what the people say and get away with it.

Obama and his cronies started a whole new ball game with ALL NEW RULES. And aparently Arizona is playing by the new rules:) Its great to see it working for our side for once.

AMEN. I’m going to call his office on Monday and thank him for ALL of his efforts! This is a someone I could get behind as a candidate for ANY office! We are LONG overdue and must put an end to the OBL.

I didn’t think you could be considered a “natural-born” U.S. citizen if one or both of your parents are illegal aliens??? At least I think that’s the argument a lot of people are making about Obama.

Perry is NO BETTER than McCain!!

We need to find out how to get Pearce or DeMint to run...AND, most importantly, find a way to stop the GOP and prevent EARLY, the consideration of ANY pro-amnesty candidates who will do nothing but divide the party....AGAIN.

This is really shortsighted. This is like right wing support of the PATRIOT Act that is biting us in the ass now that liberals are in power.

You don’t want to encourage these bullcrap politicians walking all over amendments left and right. Remember the 2nd Amendment is an “Act of Congress” too.

Think about the long game. This is chess, not checkers.

Russ Pearce is the real thing.

His son was shot by an illegal in a raid in 2006. He's a Maricopa County Deputy (works for Arpaio). Still, after being near mortally wounded.

And it wasn't like they didn't feel this way prior to that.

It's my opinion that things like that don't happen there by accident. The Mexican "government" and the narco gangs have no problem with going after family members in the U.S. of people who stand up to them. 40 years ago that wasn't true, they were scared crapless of U.S. law enforcement. Now they aren't, they know its a paper tiger.

But not Russ. He's going after them hard, in their faces. They respect that, and they will back down when he hits hard enough.

It's good that Jan Brewer is siding with him. Politically it's been a boon to her. I didn't think she had it in her.

But what does it say about our country when we have to fight this hard for what is obviously so right?

The 14th Amendment never said that EVERYONE born in the USA is a citizen. Tourists & illegal immigrants are NOT under the full jurisdiction of the USA. They don’t pay taxes, cannot be drafted, etc.

I would love to see a legislature force the issue with the courts, and see if they will rule that part of the Constitution - “subject to the jurisdiction thereof” - doesn’t exist.

I’m also willing to support a law that would deport the illegal alien, and give them the option of putting their child up for adoption, or taking him with her. Let the parent choose...

No, it cannot. It CAN define how the state interprets the Constitution, and force the Supreme Court (eventually) to rule on what the 14th Amendment meant by “and subject to the jurisdiction thereof”.

Also, there is NOTHING in the Constitution promising a mother the right to remain in the USA with the child she had here illegally.

Passing idiot law by people who claim to be conservative does nothing to promote the conservative cause in my opinion. If a law is is unconstitutional it should not be passed period. When did supposed conservatives turn into ambulance chasers and when did they start listening to politicians who were idiots and make conservatives look lkike idiots?
