Sorry to say, Obama is to write the EO AFTER the bill passes to avoid just this....Stupak bought a pig in a poke just to get the pressure off him. Of course, any EO will lose against the language of the bill in court.

Actually it will be nullified when a left leaning group like planned parenthood sues the gov’t for restricting the use of the federal dollars this bill is going to allocate for them. They will rightly argue that the POTUS does not have the authority to prevent funds allocated by Congress from being used to fund their abortions BECAUSE the bill passed does not prevent it. The whole reason for the HYDE amendment was that CONGRESS is the only entity that can restrict how the monies they allocate can be spent. The courts have consistently agreed and even though the line item veto differs in some ways, the principle is the same. The POTUS can’t overrule Congress when they pass a law he then signs. By signing the law, the POTUS is explicitly signing on to the spending contained therein.
And Stupak is stupid enough to believe otherwise? Another reason why he needs to go.

No - but if a section is added to the bill being voted on specifying that an EO will be issued - then you change the language of the bill. And then it MUST go back to the Senate for re-vote.

Correct. The exec order is not part of the bill. It is completly free standing and could have been issued whether there was a healthcare bill or not. Some of these legal experts on tv went to the same mailorder law school as Orly Taitz!

FOX is reporting that Hussein Obama will only sign the EO
upon passage of the bill in the U.S. House. That means, once the bill is signed Obama can put that EO on the back burner and eventually let it rot. Wonder what Stupek will say then?

You may be right. The Supreme Court may not say a word. Maybe the NEXT word that needs to be heard is in November. Maybe the NEXT word may have to be spoken sooner — thru civil disobedience. refusing to comply with the healthcare mandates, etc... Guess we’ll see where the battle finds up before we know how we must fight it.
