A federal judge has taken the rare step of ordering self-described anti-terrorism investigator Paul David Gaubatz to remove from his Web site some of the 12,000 documents that his son allegedly stole from the Council on American-Islamic Relations.
U.S. District Judge Colleen Kollar-Kotelly also ordered Gaubatz to return documents used in his book, "Muslim Mafia: Inside the Secret Underworld That's Seeking to Islamize America," which was co-authored by Paul Sperry and portrays the council as a subversive organization that's allied with international terrorists.
The 15-year-old nonprofit civil rights and advocacy organization says its goals are to "enhance understanding of Islam" and "empower American Muslims."
"The record ... supports a finding that defendants have unlawfully obtained access to, and have already caused repeated public disclosure of, material containing CAIR's proprietary, confidential and privileged information," Kollar-Kotelly concluded last week.
The Internet publication ban lasts until Nov. 18, by which time the judge will have held another hearing. Even if it's temporary, though, the restraining order issued last Tuesday is one of the rare occasions when a judge has ordered an author to erase published material.
"It's unusual," Lucy Dalglish, the executive director of the Reporters Committee for Freedom of the Press, said Monday, "but I think with the Internet we'll be seeing more of these kinds of cases in the future."
Dalglish added that the judge's publication-restricting order is narrowly written, noting that you "don't usually see situations where they have allegations like this."
Gaubatz said Monday that "the lawsuit was expected," and he questioned whether Council on American-Islamic Relations officials "deny the accuracy of the book or the documents" cited.
"Intimidations, threats and lawsuits are CAIR's basic tactics," Gaubatz said in an e-mail.

From what I understand of Islam, I don’t like it at all. Now, if the Muslims will allow me the freedom to do so, I intend to refrain from all involvement in their religion.
CAIR relies on litigation. However, if you strip out the Islam issue, someone “stole” some documents and published them. If they were your documents, you might be litigative yourself. There’s something to be said for an even-handed approach. I think the galling thing has to do with what’s in the documents. You might expect some interest from elected representatives or people responsible for national security. The restraining order doesn’t bother me so much as the lack of interest in what CAIR is really about. Certainly, one could look at the publication of the documents as a form of civil disobedience, which has an honorable history that includes, for example, the grand daddy Boston Tea Party. The fact that our friends in govt. are not interested is the real kicker.
I’ll tell you what I think is wrong with that book:
With a name like “Muslim Mafia,” the implication is that muzzies are criminals, instead of the cowardly thugs they really are!
If that Malik Hassan asswipe isn’t being waterboarded at this very moment, it’s because we’ve lost our will to survive as a free people.
Instead of having him court-martialed by a bunch of incompetent military jag “officers” who couldn’t get a conviction against a shplifter, I think Gov. Perry should demand to be given custody for his assault on civilian police officers.
And then have him shot “attempting to escape.”

Actually that sounds like a good idea if we could figure out a way I see what your saying we should be able to use some sort of discrimination policy they are violating. The blind people were able to stop the muslim cabbies in Minneapolis from discriminating about seeing eye dogs and the gays brought some kind of a complaint against them too.

CAIR sues ‘Muslim Mafia’ author and son
(Politico) A prominent advocacy group for Muslims, the Council on American-Islamic Relations, has filed a federal lawsuit against an author and his son for carrying out an undercover infiltration of the group in order to gather information for a harshly critical book that was just published, “Muslim Mafia.”
Judge Colleen Kollar-Kotelly has ordered the author, P. David Gaubatz, and his son, Chris Gaubatz, to appear personally in federal court in Washington this morning to respond to CAIR’s demand for a restraining order preventing the pair from disclosing or distributing thousands of documents Chris took or copied while working under a pseudonym as an intern in CAIR’s Washington office.
The “Muslim Mafia” book has drawn attention on Capitol Hill because Rep. Sue Myrick (R-N.C.) penned a foreword for the volume. In addition, it featured in a press conference earlier this month where several conservative members of Congress alleged that CAIR was attempting to plant spies on Capitol Hill.
“”If an organization that is connected to or supports terrorists is running influence operations or planting spies in key national security-related congressional offices, I think this needs to be made known,” Rep. Paul Broun (R-Ga.) said.
CAIR said its efforts to encourage Muslims to get internships on the Hill was innocuous and a routine activity for advocacy groups.
Legal filings in the case also indicate that CAIR routinely required interns to sign non-disclosure agreements. However, CAIR officials say the agreement David Gaubatz signed disappeared from their office.
The suit alleges conversion, breach of fiduciary duty, breach of contract, trespass, violation of the Electronic Communications Privacy Act. In an interesting twist, despite the book’s harsh claims that CAIR is part of a “jihadist network,” the suit does not allege libel or defamation.
David Gaubatz did not respond to an e-mail message seeking comment on the lawsuit.
CAIR does not appear to have publicized the lawsuit, which POLITICO stumbled across this morning. It was also reported Monday morning on a legal web site, Courthouse News.

I had long wondered why people on the Left had the propensity to speak more positively about people who would slit their throats than they do about their own country, which affords them more freedom and opportunity than anywhere else. David Horowitz has answered that question thoroughly and convincingly in his Unholy Alliance. Where I felt bewildered and confused, I now feel crystal clear. Unholy Alliance is such a great book.
It begins with the leftist movements at the beginning of the 20th Century, and works its way up to the present day, exploring the anti-American attitude of these movements in detail. Horowitz shows that the enemies of the US back then are largely the same group today, operating under the same misperceptions, making the same mistakes, and pursuing the same impossible utopia.
