A woman fatally shot a suspected car burglar Monday night in the parking lot of her northwest Houston apartment complex, police said.
The woman told Houston police she shot the man about 9 p.m. after she spotted him breaking into her car parked outside the apartment in the 5900 block of Pinemont at Alabonson.

Why would you think that. Being dead has never stopped a dim before. If ACORN has him signed up, he'll vote regardless of location or body temp.
Not legal in other states. If she was not in her car, she can’t shoot him because her life wouldn’t be in danger, according to the laws of most states. Look at the number of homeowners who have been charged after the fact when they shot an intruder breaking INTO their homes, or running away. I think most lawyers would advise if you are going to shoot a burglar, drag him inside afterward!
Or, perhaps the law of the old West prevails — stealing a man’s horse is a hanging offense. Updated: stealing a woman’s car is a...?

NEVER move the body. Modern forensics can tell if the body was moved at any point after it came to rest.
Even if it really was a good shoot, you will then go to jail for obstruction, falsification of evidence, tampering with evidence, and will be under suspicion of murder because of the above.
If you live somewhere with restrictive self-defense rules and it’s important to you, don’t think about moving the body. Think about moving somewhere else that doesn’t deny your right to self defense instead.
If your lawyer tells you to move the body, you need a new lawyer. btw, I am shocked at how many people say that asinine comment in this day and age.

Heck, the police have shot and killer innocent bystanders presenting less of a threat and gotten away with it.
It made sense as little as 30 years ago, but today - oh HELL no. Modern forensic investigation techniques and technology are so good it’s scary.
I second that - if your lawyer tells you to move the body, get a new lawyer. Better yet, move to some place where that is never going to be an issue.

In Texas, this is not an issue. This was a righteous shoot - and in Texas, she does *not* have to be in fear for her life to shoot a car burglar.
There use to be an alley fence down the street from my place that said”if you come on my property I’ll kill you” painted in big letters. I bet nobody came on the property.
Officer, he came at me with a screwdriver, so I had no choice!
Our instructor told us we need to be so confident with our firearm, that we won't draw it too early and it cuts down on accidental shootings (finger on the trigger when drawing, etc). He also said that when the police get there say, “there is the bad guy, here is the gun, I would like an attorney.”
Texas law is a bit different. Here we can shoot in defense of our property. We can even shoot in defense of a third party’s property.
I have been told a different mantra by the cops and trainers, depending on the situation. “I was in fear for my life, I am feeling sick and want medical attention and a lawyer.”

In Connecticut, it is illegal to protect your own property with a firearm. Doing what she did would get her arrested for murder.
We had a multiple rape/murder of a Doctor’s wife and daughter, and people demanded those type laws be repealed, and the dem senate and Congress refused.
In the mean time, teenage kids in Hartford a New Haven get shot from cars in the street, and the Congress never tried to make that illegal: trying to stop drive by shootings. Everyone knows that if they made it illegal, drive by shoootings would stop immediately!

LITERALLY, we are suppposed to jump out a window if it is availabl and escape first before using deadly force against someone.

Justified or not, killing someone is not a pleasurable experience.
If she was not under direct threat, she may very well be haunted by that fact the rest of her life, because she could have kept the gun on him while she called the cops, or maybe just wounded him.

Remember the Texas pick-up truck driver who witnessed from a distance as a highway patrolman was shot by a motorist he'd pulled over? The pick-up truck driver got his deer rifle off the rack and blew the perpetrator to hell from 50 yards away. The police all just wished he'd gotten there a little earlier and didn't even release his name to the press.
Texas has a “nightime” law. If someone is stealing at night , you can use lethal force to stop it. Sorta location sensitive, though, better she is in Houston than Austin.....

Police are always more favorable toward the use of guns to protect themselves, than they are toward the use of guns by “civilians” to protect mere civilians. I am sorry, but that is how the brotherhood feels about fellow policemen.
I used to live in Texas, and was actually told by my lawyer that it was OK to shoot someone trying to steal a car. I would not enjoy doing that at all, but I do favor capturing car thieves, or scaring them away.
In some other constituencies it is illegal (assault) to point a gun at a human being, whether the gun is loaded or not. That means that if you are threatened and defend yourself, even with only a show of force, you must expect subsequently a long and uncertain legal problem, which could include jail time, a record, and loss of any gun rights you had enjoyed. I suppose protecting your life is worth it, but the law is really protecting criminals in such cases.
Many states (like NJ) ban even electrical defense weapons. In NJ, a sling-shot (which, for some unknown reason, they call a “slung shot”) is a prohibited weapon, in the same general category as an assault rifle.
Since these laws were promulgated, the rate of violent crimes and major property crimes has: a) dropped dramatically; b) stayed the same; c) increased. Which do you think?

Oh course, the screwdriver defense did not work for the HERO of the New York City subways, Bernhard Goetz, some 20 years ago, or so.
They even gave him a gold-plated .45 auto hand gun as a reward, later! LOL.
That's why Texas is awesome. I feel safer here. My only concern is that I don't shoot my neighbor thru the wall.

“Moving the body” was hyperbole! Better I should have said “lure him indoors and then shoot him”. My point is that most jurisdictions do not allow you to use deadly force to protect property — especially remote property.
Everyone also should realize that there are a lot of bad lawyers out there.

Have you ever been the victim of a crime or break in? I have, several times and when it happens to you, you just want the guy dead on the spot. All of your care, concern and feelings of mercy for the guy, go right out the window.
Personally I think every burglar, car thief and mugger should be shot dead on the spot, dragged back to their “home” neighborhood and hung from a lamp post.
I’ve been the victim of crimes, yes, and didn’t like it one bit. Wanted them dead for a while, but I got over it since he got away.
I’ve also killed people in war, and even though it was self defense, it’s not a fun thing.
If I’m ever the victim of a break-in again, I’ll hold the son-of-bitch for you, send you an e-mail, and you can come here and kill him (or her)
