Gibbs Says He Doesn’t Know if White House Has Reviewed Constitutionality of Forcing People to Buy Health Insurance Monday, November 02, 2009 By Fred Lucas, Staff Writer

(CNSNews.com) - White House Spokesman Robert Gibbs said today that he does not know if White House lawyers have reviewed whether it is constitutional for the federal government to order individuals to buy health insurance and said that the White House is not seriously considering the concerns of people such as Sen. Orrin Hatch (R.-Utah) who believe the mandate is not constitutionally justified.

This was the second time in two weeks that Gibbs had dismissed concerns that the Constitution does not give the federal government the power to force individuals to purchase items the government wants them to purchase.

Hatch told CNSNews.com last week that forcing people to buy health insurance cannot be justified under the Constitution’s Commerce Clause.

“But here would be the first time where our government would demand that people buy something that they may or may not want,” Hatch told CNSNews.com. “And, you know, if that’s the case, then we didn’t need a ‘Cash for Clunkers,’ all we had to do is have the federal government say you all got to buy new cars, no matter how tough it is on you. You know, they could require you to buy anything. And that isn’t America. That’s not freedom. That’s not constitutionally sound. Now, there may be some gimmicky way that they can do this, but I can’t think of a gimmicky way that would be constitutionally justified.”

And just for the record, O don't give a sh** about no steenking Constitution.

“oh, so you want to be held to some antiquated document written by rich white men over 200 years ago”

Yep, the Constitution means NOTHING compared to the elite minds that are making the decisions today. This is their worldview. Just get them to admit it so we can have an honest discussion from there.

Bingo on both points. Hatch finally woke up , and Obama could care less about the Constitution. He won his job in deference to the Constitution, so now it matters little to him or his Dem scoundrel minions.

We know they have 4 votes in the Supreme Court. They only need one more to win.

If they can force me to buy Health Insurance from the US Gov’t; then can’t they also force me to buy crappy US made cars at whatever price the US Gov’t decides to sell them at?

Why stop at Insurance?

Why would they suddenly start checking the Constitution?

And what about the rest of the bill, Orin? I’d be surprised if you could find any two consecutive lines that have a basis in expressed Constitutional powers.

I can just see the White House announcing that it “will” study the constitutionality of this, then coming back and indicating that indeed, there may be big problems in the opinion of their own ‘constitutional scholars’ with this forced purchase thing, but then getting real cute and suggesting that they might as well go ahead and do it, as long as there are no objections.......folks??? we’re waiting to hear from you.....email us.....if we don’t get lots of emails we’ll assume it’s allright, and just go ahead with it......okay...?????

Correction. That should be “Obama could NOT care less about the Constitution.”

To say that he could care less assumes that he cares somewhat. OTOH, if he could not care less, that means he does not care at all and therefore could not care LESS. Do you understand the difference?

You and millions of others, including very educated people, have either written or vocalized this old expression of “caring less” because it is just that, an expression one uses without reflection. But it is not an expression founded in logic.

You’ll notice after awhile that a lot of the really old timers (say, circa 1998) who are still around, are essentially old farts who have long sense lost any residue of respect for anyone who signed up post-2002, and will bear fangs if you point out a minor error of theirs. If you point out a major error, there is much foaming at the mouth and gnashing of teeth. Old dogs and new tricks, so to speak.

Just a personal observation.

Did I hear correctly on Levin’s show today that Obama’s own WH lawyer is the SAME guy who represented Elian Gonzalez’ FATHER in attempting to get the child back to Cuba?????????????

If that’s true, it’s just more evidence (as if we needed more) that Obozo is NOT on our side, and is not a person sympathetic to citizens of this country.

In this case, the person (and there are many like him/her who use this faulty expression) is a fairly new FReeper, and the person who takes issue with my “exposition” is a “well-seasoned” member of Free Republic.

Nevertheless, notice that the person who posted to me did not state that I was wrong and used what I am sure he thinks is a clever reposte.
