School nurses mistakenly gave the swine flu vaccine to two students who didn't sign up for it - including a Brooklyn girl with epilepsy who wound up in the hospital.
"I was outraged," Naomi Troy, 26, told the Daily News after her 6-year-old daughter, Nikiyah Torres-Pierre, had a possible allergic reaction to the shot.
Officials at Public School 335 in Crown Heights called an ambulance to take Nikiyah to SUNY Downstate Medical Center when she fell ill following the arm jab.
"My stomach was hurting, and I was itching," Nikiyah said after she was released from the hospital.
The snafu and a similar mixup at a Staten Island school came in the first days of the city's in-school H1N1 vaccination program.
City officials have stressed the vaccine is safe and urged parents to sign up for it - though less than half have sent in permission slips.
Troy was waiting for advice from her family doctor on whether Nikiyah should get the shot since she takes medicine to control her epilepsy.

Naomi sniffs an opportunity to make big bucks from a lawsuit. This is a crock. The mother had put in an inquiry to the girl’s doctor as to whether she should have it. The answer hadn’t come back yet, but would surely have been yes — epilepsy is not a contraindiction to the shot, and kids attending huge urban public schools, and riding public transit to and from school are at high risk for catching this flu — and the girl would have gotten the shot anyway. The photo looks very posed, and there’s no indication in the article that the girl suffered any ill effects — she was promptly released from the hospital, where she was apparently only taken as a precaution, and mom isn’t mentioning any medication or follow-up care that’s been prescribed.
Well here is one way to expand the vaccine testing population.

A young friend of ours had her family inoculated on Friday, at a local clinic. The eighteen month old baby now has a bad case of the flu with a croupy cough that kept both the baby and mother up all night. This time last year, the baby was hospitalized with a croupy cough that was associated with the flu.
I have really never thought schools should be giving any kind of medicine or shots or anything else. I know when I taught HS there were kids who went to the school RECEPTIONIST to get their meds. That just seemed plain old dumb. I would much prefer the onus to be on the parent if something goes wrong.
kids are at high risk for catching any number of the 15 strains of flu that show up each year.
Anyway, if the mortality rate for this flu is less than others (less than 1 percent of hospitalized case) why take goo in your arm, of something that has no proven efficacy or predictable side effects?

There is a bigger point here. A Government worker/Public school employee gave a child with a pre-existing health condition a vaccine with unknown side effects against the wishes of her parent. That alone leaves the guilty open to litigation. And how can you question the motives of the parent based on the picture taken of she and her child?
If someone injected my six year old without my permission, I would be very irritated.

First time I ever got the flu shot and probably the last.

Obviously the mother was planning to have the girl get the vaccination unless her doctor nixed it, or she wouldn’t have put in the inquiry to the doctor.
When you instruct someone NOT to give you a shot let alone your child, it is serious business. Especially in the case of a pre-existing condition.
It did not contain thimerosal. I got the shot at the Kaiser clinic and haven't contacted my doctor about it. I have been taking Nyquil and using nasal spray.

I think the receptionist "giving" medication means (usually at least!) cases in which the kid is on prescription medication to be taken throughout the day -- the parents can either keep the kid home or give the appropriate number of doses and instructions to the school.
I agree with everyone else on this GS.....Every FReepers here has bitched and moaned about public schools letting girls have birth control and abortions with out parents consent or even knowing about it. When I was a kid we needed a permission slip for everything...even field trips. Parents are still in control and if this mom does not sue, it means a loss of power from parents to schools, whom are thinking they are the parents and not the mom and dad.
I do not know if the child was affected....I too have epilepsy, and only have my allergy and asthma doctor give my shots. He knows all the meds I am on, so I trust that he would know that I should or should not take the flu/H1N1 shot.

Just on the negligence factor, without real damages we’re looking at 7 figures. Actually the parents risk a danger in bringing a suit in NYC. A judge might rule for the city on the grounds that the child was better off getting the flu shot. Seeing as Bloomberg is creating a fascist nanny state in NYC I would not be surprised if he directs his Corporation Counsel to zealously defend the city and offer no settlement, hoping to get a favorable nanny ruling.

No we did not...but I heard of kids who did. I heard of a gun club in West Virginia that the boy brought shotguns and held them in the Principal’s office till it was time to shoot. Those were the days!!!
Yes, that’s exactly what it was, however if something goes wrong, I think the parent should be there. I know it is an inconvenience, however the kids don’t belong to the school, and the school has no business medicating them. The receptionist had no medical training. Of course, teachers are also mandated to do things we are not trained to do. And if we get it wrong, we are in BIG TROUBLE.
Why schools should NOT be clinics for convenience!!

I agree. When a non-medical professional is handing out medications (or overseeing injections) for large numbers of kids there are bound to be mistakes made.
Vaccines are immune from lawsuits. (pun intended)
Wonder if she got the shot which is supposely safe for kids that age or if she went with the easier nasal one that is not safe for kids under the age of 6yo? The nasal one is a live virus the shot isn’t.

More often than not—they are babysitting kids, refuse to enforce rules and demand discipline, and trying to be a ‘free’ healthcare clinic...
You didn't get the flu from the shot.
The symptoms that I have are included in the possible side-effects from the vaccine. Whether it's coincidence or not I can't say.

What she intended to do or actually would have done cannot be determined. In any case, no one was given permission by the parent to inject their daughter with goo.
I don't care if the children they gave the shot to illegally(and it is illegal)had reactions or not, I would sue for violation of my, and my child's, civil rights.
They get plenty of FED at home.
In this case I wouldn't blame the family for going for the gold. I'd have my kid's college education paid for, giving her a shot without my permission in a non-emergency situation.

H1N1 flumist disaster!

I posted on this topic before but just want our experience to be shared. My 2 daughters were both vaccinated using the live flumist. The next day the youngest developed a high fever and sore throat. This continued over the next few days but she also became achy with a bad cough and wheezing in the lungs. I took her to the pediatrician 3 days after the vaccination where she took nasal samples to be checked for H1N1. Her examination was consistent with H1N1 and especially with the proximity of the vaccination. She and I both feel she got the the flu from the flumist. Even though the printed material says you cant get it from the vaccinationmy doctor confirmed you can and may pass it on to immunocompromised people. It is rare to have this happen though. Being a pediatric nurse myself, I am typically for an ounce of prevention HOWEVER I have definitely second guessed this H1N1 flumist! My daughter is currently on 2 antibiotics, tamiflu, and albuterol. With that said, I certainly would take this (even though it is terrible) over the full strength virus...but ultimately i think the killed virus injection is safest. This is mild in some but I can see where it is definitely a deadly virus to othersespecially the children.
Just a side notemy kids are home schooled and we had been in no contact with anyone sick in the past month. I am on leave of absence and did not bring anything home from work. This is why we are so suspicious of the flumistnext day 24 hours later flu symptoms set into full swing. My oldest daughter had no problems. My post is just to raise awareness and inform others of our experience. Yes, I wish I had waited and used the injectionbut I still would have vaccinated. This experience only has shown me how serious this isand Im still pro-vaccination just not pro flumist:)

Just think all the people who get the flu from the inoculation can also spread the flu.
