Not impounding immigrants' cars just makes sense
San Francisco Chronicle / sfgate.com ^ | Saturday, October 31, 2009 | C.W. Nevius

Posted on 11/01/2009 1:49:43 AM PDT by thecodont

The announcement that starting Sunday, San Francisco would no longer impound the cars of drivers who do not have a driver's license - many of whom are undocumented immigrants - set off a roar of outrage in the city and beyond.

It's been called a "get out of jail free pass" and "sanctuary on wheels."

...

The reality is that undocumented immigrants are in double jeopardy. They are not allowed to get a driver's license - although they could in California until 1994 - but if they are stopped their car is taken away ... because they don't have a license.

The theory, apparently, is that the roughly 2 million undocumented residents of California will see the light and will decide to take buses, trains, and water taxis.

Right. And how's that working out?

Here's a news bulletin: They are driving to work, to take kids to school, and to the store. They are driving without a license, without insurance, and without an incentive to stop if they are in an accident. In the worst case scenario, says Gascón, they convince themselves that it makes sense to try to run away from the police.

"After 1994, when the license law was repealed," Gascón said, "police pursuits went up."

Why not make a run for it? You're already going to lose your car. That isn't logical, but it doesn't mean it doesn't happen.

If they knew they were only going to get a ticket, like anyone else, wouldn't they be less likely to take off on a dangerous police chase?

I'd like to put a [/SARC] tag on the title because I don't agree with the author's premise. The problem of hit-and-run fatalities in this state is HUGE and I think much of the problem stems from the large number of illegal alien motorists who feel they have nothing to lose by running off. Would "legalizing" these illegal alien motorists help solve the problem? No. Why not deal with immigration issues?

Even if they don’t deport them, impounding their cars and requiring a driver’s license to release them else they are auctioned off or sold for scrap often enough will bankrupt them and make them leave.

Oh, forgot to mention - it will also make the city a lot of money.

It’s what Dallas and other Texas cities do.

re: Why not deal with immigration issues?

That would solve, or least address, a lot of other problems too. Until we stop treating symptoms and start treating the disease itself not much is going to change.

Same with Iran. Much of the trouble we see in the world today can be traced right back to the mullahs and and their perception that they are on an Allah-given mission to convert the world to their religion.

We should respect their property rights, including their ownership of a car. They should also respect our rights and our laws. If Mexican citizens respect our laws and stay home, or respect our laws and come here legally, we should not impound their vehicles. If they enter our country illegally, we should transport them home and only keep their vehicles if they don’t have the money to pay all our costs in enforcing our laws. [And BTW, we should fingerprint them, ban them from returning and from any path to citizenship for life, and lock them up for a couple years if they do return.]

What part of ‘illegal’ doesn’t C.W.Nevius get?

We shouldn’t be coddling criminals and illegal aliens!

So, does this mean they will now get a driver’s license, registration and have insurance? Let’s see they broke into the country, continue to break the rule of law each and every second they are here, don’t worry about insurance, accidents, health and welfare of those they hurt…the citizenry is on the hook for all their social issues wasting multiple billions of dollars to start with which could be better spent else where. So what makes anyone think this human debris will do what everyone else has to do; look at their own turd-world origins, they ran away from that and the political class wants to do the same thing here. So the masters of smart think they will be getting a different result. “Liberalism is a Mental Disorder!” So, does this also mean the rest of the citizens do not have to obey the law either, can drive without a license, not be required to have insurance and no public responsibility? How about all those individuals that Cal State DMV will not provide a license to, what should they do? Appears the Progressive Animal Farm brings no equality under the law or common sense to in the support of liberty and freedom. And such has too many designs to be just a miscalculation!

Seizing Vehicles is only the Start.

There is a Legal Principle called “The fruit of the Poisoned Tree”.

All possessions purchased with funds obtained after entering the Country Illegally should be Forfeit.

That is the way it is with the Proceeds of Drug Activity.

In which case, the owner gets the car back and the alien goes to jail.

However you look at it, that is just an additional crime.

Immediate deportation solves the problem.

And throw them out of the country! Problem solved. If you just give them a ticket why are they going to need a license or insurance like everyone else? They will just continue driving without these little inconveniences.

Don’t they have “equal justice under law” over there? If one class of people isn’t punished, no others should be punished. If one is not subject to laws and regulations, no others should be subject.
Kind of basic, or it used to be.

it all comes down to the big lie we hear over and over again. “the problem is too big and the only solution is amnesty”
Until the scoundrels that tell us these lies are voted out,the problem will only fester and grow.
Do you hear me Juan Mcain? Lindsay Grahmnesty?

In the PR Massachusetts, catch and release has been the de facto policy on illegals for a long time.

Why should a legal citizen be required to have a drivers license and car insurance if Illegals aren’t?

They make it sound as if this is some great Catch-22. The whole point is that they are not supposed to get the car in the first place since they are not allowed to drive one.

I think we should adopt Mexican immigration laws and apply them to Mexicans.

They don’t want anyone coming in unless the can easily take care of themselves financially and can contribute financially to the country. They essentially want only “professionals.”

IMO the illegal should be arrested and put on the bus back to Mexico after the car is driven to the impound lot. The nerve of these people to come here illegally and then drive around , many of them half drunk, on roads paid for by Americans.

You just gotta love the liberal mindset.  If criminals run from the law, change the law.

That is the very essence of why we had law and order in the 50's but not now.  PC and touchy-feely have ruined our civil protections.
