Democrats Go To Court In NY-23 »

The Democrats have beaten the Republicans to court in NY-23, obtaining an order to show cause that requires the impounding of voting machines for what is expected to be another tight congressional special election.

"Most of the time, you don't bring this until the day after the election, and then only if you think the race will be close," said attorney Frank Hoare, whom I reached on his cell phone as he was driving back to Albany after filing the order in Elizabethtown.

"The Republicans usually play games and start the action the day of the election; in an effort to beat them to the courthouse, I started the action today," Hoare continued.

"They started the morning of in Murphy (the NY-20 special election between now-Democratic Rep. Scott Murphy and Republican Assemblyman Jim Tedisco in which a recount dragged on for weeks). They just so happened to find the most conservative judge in the whole congressional district. Not that I would accuse them of judge shopping."

This order was signed by state Supreme Court Justice Robert Muller, who just so happens to be a registered Democrat (although he was cross-endorsed in 2008, as so often happens in judicial races, and ran on the Conservative line).

I asked Hoare if he had engaged in a little judge shopping of his own, he laughed and said: "I randomly came to Essex County because it's one of the counties we're concerned about. Muller is in Lake George. I have no idea about his party affiliation."

This order is pretty standard, except for one point of interest: It directs three counties - Essex, Clinton and Oneida - to let people who made the federal registration deadline but not the state and local deadline to vote on paper ballots, not affidavit ballots.

I love how the Dems always acuse the "R"'s of dirty tricks when in fact they are the ones that are dirty. These people have no shame. Maybe the smart guys at Club for Growth will come up with a way to combat this garbage, because the Republicans never will.

Correct. Their goal is always to keep it close enough where they can steal enough votes and not be over the top conspicuous.

Got a Hoffman aide email today, they are swamped with volunteers. Hope they have enough to be at every polling place....

Hoffman ought to be able to use this little manuever to his advantage. It smacks of the two-party cronyism and elitism that people are rebelling against all over the place.

This ought to motivate enough people.

Just think, if this was a two-person race, the trust-fund babies the NRCC sends in to micromanage these races would just sit around and whine to themselves and each other.

When I look at the biggest causes of the sad state of affairs of this country, the missed opportunities of GOP majorities, backed by the plurality/majority of the American people, are pretty high on the list. This opportunity was blown by a group of elites within the GOP, the kinds of people who thought it was more important to be liked by the kinds of people who hang out in the Georgetown Starbucks than it was to do the right thing.

I once wrote a lot about that on the forum. About Rush threatening to leave NY, and then they said that he stayed.

Then I got replies that said his home is in Florida [I knew that] but that he still had ‘business concerns’ in NYC and that’s what they tax him on.

As you write, they are now making him document everything. Wonder why he didn't follow through on his threat to move it out of NYC?

Where the JACKASS party always turns when the outlook looks grim (find a tyrant in black who's on the DNC payroll). Keeping polls open longer, having valid ballots thrown out while ensuring invalid ballots are counted, pushing intimidation and fraud....that's how DUmocrats win. If they actually played by the same rules they force on everyone else, they'd never see anything other than defeat.

It appears to me the counties listed are the more left-leaning. Clinton and Essex are near the Canadian border, flooded with 3rd world immigrants and people dependent on assistance. Oneida has an Indian reservation. Just sayin’.
Not listed are Jefferson and Franklin counties. In that district the more west you go, the more conservatives you’ll find.

Electric bills went up nearly 100%. Precursor to cap & trade—getting us used to it. Taxes wiped out all profit from hubby’s new business. Never mind taxes...how about the fees? I have a $45/mo. basic phone plan that actually costs around $90.

Locals raised the hotel tax; registrations went down. Fewer customers for the few remaining stores and restaurants.

Thruway raised tolls; fewer drivers on Thruway and the trucks are tearing up the country roads. I guess we need another toll to make up for the shortfall.

What a bunch of dunces.

Hannity needs to read these guys the riot act. Hoffman supports what you support why aren’t you helping him. There was no primary and 3 of the eleven County Chairmen made this decision.

Steele is letting the Country Clubbers and the Northeast elites call the shots. They are funneling most of the organization and support to oppose conservative candidates and then say they can’t win.

Call the RNC, the NRSC, and the RNCC and tell them to stick it!!
