AP Says Attorneys for Shepard Fairey, Obama Poster Artist, Make Major Admissions in Case

A statement emerged tonight from AP concerning its long battle with artist Shepard Fairey over his use of an AP photo as the basic image for his famous Obama campaign poster.

AP claims that Fairey's attorneys admit he tried to destroy some evidence, faking others and that his attorneys have sought to get off the case.

Statement from Srinandan R. Kasi, VP and General Counsel, The Associated Press, follows. *

Striking at the heart of his fair use case against the AP, Shepard Fairey has now been forced to admit that he sued the AP under false pretenses by lying about which AP photograph he used to make the Hope and Progress posters. Mr. Fairey has also now admitted to the AP that he fabricated and attempted to destroy other evidence in an effort to bolster his fair use case and cover up his previous lies and omissions.

In his Feb. 9, 2009 complaint for a declaratory judgment against the AP, Fairey falsely claimed to have used an AP photograph of George Clooney sitting next to then-Sen. Barack Obama as the source of the artist’s Hope and Progress posters. However, as the AP correctly alleged in its March 11, 2009 response, Fairey had instead used a close-up photograph of Obama from the same press event, which is an exact match for Fairey's posters. In its response, the AP also correctly surmised that Fairey had attempted to hide the true identity of the source photo in order to help his case by arguing that he had to make more changes to the source photo than he actually did, i.e., that he at least had to crop it.

The “Obey” posters were drawn in 1989 of Andre the Giant ... but what’s creepy, is how presciently Andre looked like that Empty Suit. Perhaps that was the idea.

Fairey issued his own statement tonight. The L.A. Times reports:

Throughout the case, there has been a question as to which Mannie Garcia photo I used as a reference to design the HOPE image," Fairey said. "The AP claimed it was one photo, and I claimed it was another."

New filings to the court, he said, "state for the record that the AP is correct about which photo I used...and that I was mistaken. While I initially believed that the photo I referenced was a different one, I discovered early on in the case that I was wrong. In an attempt to conceal my mistake I submitted false images and deleted other images."

Hmmm, on the one side we have Shepard Fairey, creepy, gay, totalitarian artist and on the other side with have the AP, Associated with Terrorist AP.

Who can you possibly root for? I root for the Judge. I root that he drags this case out as long as possible. I root that this case becomes the Bleak House case of our time. I root that this case destroys both sides.

Indeed, I'm rooting for the judge to dismiss his suit with prejudice, but keep AP's counterclaims and to refer him for prosecution for his wrongdoing in the case. Courts take lying to them seriously (unless you're Bill Clinton), and Fairey is likely to get a felony conviction (one less Obama voter) and maybe even some time in the jug.

Has no one pointed out to the defendant’s lawyers that photographs of the president (who symbolically represents the country) are public domain no matter who took them and no one (not even the photographer or the president himself) has exclusive rights to them?

This is established law.

There is zero interest for their client in allowing the case to avoid that roadblock.

Good find. I had an entire rant ready to go but decided not to post it. Obama is a fraud from the word go but his “organizing” skills are something else. He fakes out half of America with nothing but BS. Truly sad indeed.

As far as I know, all photographs of the president are NOT public domain. Only photographs taken by government employees would be public domain as the US government cannot copyright work it produces.

I’d like to see some case law to support your assertion.

I hope they use this story on Fox etc. to show who Fairey is as an artist and highlight his awful posters with the letter that Obama wrote to him. .....”The political messages involved in your work have encouraged Americans to believe they can change the status-quo.” .... “I am privliged to be a part of your artwork and proud to have your support”.

Here are examples of his “lovely” work on FR and the letter he recieved from Obama. This alone is damning as far as I am concerned re Obama. The art that a man loves can reveal much about him. In this case it obviously does.
