ESPN Says Rush Is Out. Gateway Pundit Details Smears.

The "race card" game is still alive and active, with the recent treatment of Rush has proven.

It really is outrageous. Right from the first charge we posted Monday. The formula is familiar … spread lies … here … and here … and my favorite, here. Then put pressure on the NFL management to act, responsibly, or face the same fate ….. raaaaaaaacist. The end result … Rush is being forced out.

Rush Limbaugh is expected to be dropped from a group bidding to buy the St. Louis Rams, according to three NFL sources.

Dave Checketts, chairman of the NHL’s St. Louis Blues and the point man in the Limbaugh group attempting to buy the Rams, realizes he must remove the controversial conservative radio host from his potential role as a minority member in the group in order to get approval from other NFL owners, the sources said.

Maybe a few season ticket holders should boycott the games until they get a more representative fabric of America playing the games. This whole race matter is rediculous and is driving many of us crazy since it’s largely driven by the left.

Goodell is a wimp and ESPN is a bunch of over-paid jock-sniffers. Rush is a patriot and a genius, and infinitely more important than either ESPN or the NFL.

I expect to see Rush’s lawyers at it tomorrow. Big time.
http://newsbusters.org/blogs/nb-staff/2009/10/14/bozell-cnn-msnbc-i-hope-you-have-good-lawyers
Bozell to CNN, MSNBC: I Hope You Have Good Lawyers

“CNN and MSNBC were given ample opportunity to come clean, but both are continuing to masquerade malicious lies [against Rush Limbaugh] as credible,” Media Research Center President and NewsBusters Publisher Brent Bozell said in a statement today.

Yesterday, Bozell promised to report back publicly with how CNN and MSNBC responded to his challenge to put up – or shut up – proof that Rush Limbaugh actually stated the racist quote that both cable networks attributed to him as fact, or to immediately retract and apologize for their participation in spreading an outlandish lie.

Talk show giant Limbaugh denied having ever stated, “Slavery built the South. I’m not saying we should bring it back. I’m just saying it had its merits. For one thing, the streets were safer after dark.” Further, it has been established that this was a fabrication pushed through the Internet, intentionally designed to destroy Mr. Limbaugh’s reputation at a time he is attempting to purchase a professional football team.

In addition to this public call to action, Mr. Bozell overnighted letters to CNN President Jonathan Klein and MSNBC President Phil Griffin to ensure both took the matter seriously. Both CNN and MSNBC failed to respond appropriately.

This racist stuff from the left was despicable.

It is especially despicable when a.) they know it's not true or b.) they don't want to know that it's not true and, therefore, make no effort to check out its veracity.

This particular event is one of the best demonstrations yet of the absolute and total corruption of the media by liberalism.

For some on the left it was despicable behavior. For others it was lacking a veracity check. For some others, all this racist crap thrown at Rush is another example of political correctness gone wild, promoted with the tactics of Alinsky's Rules for Radicals.

This is both a political war and a culture war, with Obama in the center.

The NFL Owners are an exclusive club. They get to vote on who can own a team. It won't matter what Rush does, if the owners vote no, it's no.

Not saying it's right, it's just the way it is.

Counter Insurgency.....

The NFL is Racist....we need more Chinese running backs and Mexican receivers.
What can a Black fullback do that a Sumo Wrestler can’t do ? Have you seen what a Sumo wrestler in a 4 pt stance can do ? Wow ! Oh.....Sumo’s are Japanese ? Nevermind.

And those Mexicans running across the Border, dodging border police, zig zagging around Cactus, submarining across the Rio Grande, bringing in Drugs to ...Oops, nevermind.
We need a more diverse NFL, maybe some more Somoans or Eskimos, throw in some more white guys, and limit the Black players to 20 % of the Team.
We need exact representation of the population norms.
Gee, are you sure those Sumo guys are not Chinese ? They all look the same, ya know ?

Yeah, the NFL instituted "Cap and Trade" back in '94 as a way to make the market for players "more fair".
I'm surpised that Rush would want to have anything to do with it.

There is not much chance of him succeeding in court - as the quintessence of a "public figure", under NY Times v. Sullivan, he has to prove (A) actual malice in combination with (B) knowledge of the falsity of the claims on the part of those making them, along with (C) actual falsity of the information presented. Once over hurdles A + B + C, he has to prove damages. C is easy. A is easy with regard to Jackson or Sharpton, but unlikely for the mindless readers on ESPN or elsewhere. As far as the media figures are concerned - say Matthews or some of the ESPN anchors - they are famous for reading teleprompters and have not done any original spadework as journalists in years (if ever). So, the pathetic state of the art of media journalism as now practiced actually works in their favor (i.e., it might be hard to show B - that they had knowledge of the falsity of the claims they were reading on the air).

Then, even if you get past all that - you have to get to damages, which, will probably be negative if this works the way it usually does, as Rush turn the entire controversy in his favor.

It was pretty much my point that in order to sue for libel or slander - he has a very difficult standard to meet because he is a public figure. If he had been an anonymous investor and the same torrent of false information had been unloaded on him, he would have a relatively easy time. But in US law - as decided by the SCOTUS in 1963 (the Sullivan case)- being a “public figure” makes all the difference in the world.

Black conservatives need to feign outrage at the “MSM” for not reporting these things at the time they were said..accuse them of covering up for Rush. This would put the MSM in a bind to either look incompetent, racist, unprofessional or like they just repeated the quotes out of pure hatred.

Ordinarily, you’d be correct, however, there are a couple of differences in this case. First there is no attribution for the quotes. The slander occurred when they echoed the comments of others without doing due diligence to make sure the information is correct. Second, they were put on notice by Rush that these comments were false and that Wiki still notes these as “under dispute” they cannot use that as a cover once they have been put on notice. In the case of the National Enquirer, this is exactly what happened. I see the biggest exposure to Sharpton and Jackson. They could be in for some real problems. In any event, SUE THE B@$TARDS!!!

I’d have to go back an look at those cases, IIIRC they were based on invasion of privacy or false light, not libel. What’s interesting is that different countries have very different standards, and, for instance you see a lot of libel actions brought in the UK, because the standard there is much easier for plaintiff’s to meet. Liberace actually sued a British publication for insinuating that he was gay. I think he was awarded ~$600K in damages. What the defendants did once he subsequently died of AIDS, I don’t know.

CNN has damaged Rush Limbaugh’s chances of purchasing part ownership of a business by falsely reporting on air (to dozens of viewers)that Rush said things that he didn’t. Rush deserves an apology and money damages.

I find it extremely hypocritical of Blacks like Shelia Jackson Lee to want to prevent Rush from buying a football team. For so many years blacks were prevented from buying what they wanted to buy and had the money to buy: a house in a good (white) neighborhood, a dinner in a diner, etc.

Yeah - but let’s face it - what is due diligence for an ESPN on the air “reader”? A. Nothing. The standard is non-existent. They can blame it on the teleprompter.

Most of what I heard was an echo chamber effect where they were reporting what Sharpton had said (which was clearly false), or were making a reference to the general level of controversy without asserting a specific quote.

I agree that once they were on notice, specific notice, and they continue to assert this kind of falsehood, that reckless indifference is essentially malice.

At the same time - think the the aftermath of Tawana Breawly. I think the DA up there, who got a judgment, has yet to see anything out of Sharpton of Maddox.

Being the businessmen that they are, will they choose to deal with all that and allow Rush in, just to make a political statement, or will they walk away?
