Stings were conducted at seven gun shows in Tennessee, Ohio and Nevada
Investigators hired by New York City conducted stings at gun shows in states that have not closed the "gun show loophole'' and found some vendors openly selling weapons to buyers who admitted they couldn't pass background checks.
The stings, described in a city report released Wednesday, were conducted at seven gun shows in Tennessee, Ohio and Nevada. Those states are among the many that permit private unlicensed dealers, known as "occasional sellers," to sell weapons at gun shows without conducting background checks. Some 30 weapons were sold to NYPD undercovers, Police Commisoner Ray Kelly said today. The avereage sell price was around $1000, he said. Four people were arrested.
Gun-control advocates say the loophole makes it easier for criminals to acquire guns and prevents law enforcement from being able to trace those weapons if they are used in crimes.
Nine states, including New York, have passed laws to close the loophole, requiring background checks on at least all handgun purchases at gun shows. Mayor Michael Bloomberg has long campaigned for Congress to close the loophole, and for states to do it on their own if the federal government does not.
Even in states that haven't closed the loophole, federal law bars "occasional sellers" from selling guns to people they have reason to believe would fail a background check.
This is where the Bloomberg operation says 19 out of 30 sellers broke the law during the investigation, in which undercover buyerswore tiny cameras concealed in baseball hats and purses and audio recorders hidden in wristwatches.
In each purchase, the investigator showed interest in buying a gun, agreed on a price and then indicated that he probably could not pass a background check. Most sellers allowed the purchases anyway, responding in some cases by saying, "I couldn't pass one either,'' or ``I don't care,'' according to the city's report.
Two assault rifles and 20 semiautomatic handguns were bought this way, the report said.
The 11 dealers who refused sales showed they knew the law.
"Once you say that, I'm kind of obligated not to," said one seller, according to the report. "I think that's what the rules are."
"Fact is, you done told me too much," said another who refused. ``I wouldn't sell one to you at all."
The city has no legal authority over the dealers and is using its findings to make a point. A copy of the report is being sent to every member of Congress and the findings will be shared the Bureau of Alcohol, Tobacco, Firearms and Explosives.
"The gun show loophole is a deadly serious problem, and this undercover operation exposes just how pervasive and serious it is,'' the mayor said in a statement.
The undercover operation took place from about May to August and its $1.5 million cost was paid by city taxpayers. The city hired a team of 40 private investigators from an outside firm to make the purchases.
The sting comes three years after Bloomberg's administration conducted a similar operation focusing on illegal straw purchases at gun shops in Georgia, Ohio, Pennsylvania, South Carolina and Virginia that authorities believe were responsible for selling guns used in crimes in New York City. (A straw purchase is when one person fills out the paperwork and buys the gun for somebody else.)
Bloomberg's administration brought a civil case against 27 gun dealers targeted in its 2006 investigation.
As a result of the suit, 20 dealers are being monitored by a court-appointed special master. One is out of business, two more are expected to be put under monitoring agreements and three were dropped from the suit. A final dealer settled with the city but the terms did not include a monitor.
Investigators in this year's sting also attempted straw purchases at gun shows, and were successful 16 out of 17 times.
The city said it was not planning civil action this time around.

If the state doesn’t require they run a background check as an occasional seller, then odds are they won’t do it. But if somebody admits they couldn’t pass a background check, then they should not sell to the person.
What is needed is prosecution of individuals, not more restrictive laws. But of course, that’s never good enough for Communists.
At "around $1000" those must have been some very nice rifles and pistols. You don't suppose they were offering $1000 for $400 guns, do you? In this economy it might be tempting.
If arrests were made then there are plenty of laws to curb this type of arms selling. Why do we need more?

The Mayor of New York is running stings in Ohio? How about if Ohio investigators come over to your city Mayor Bloomberg and start busting the mobsters and the racketeers that run your town?
I wonder how many people have been caught committing crimes, in NYC, with guns purchased in other states using the “gun show loophole”. I’d guess, very few.

I just checked on the online auction sites (to see if I had missed some massive inflation in gun prices) and you can buy sub-$500 Glocks (new) and sub-$800 ARs and AKs by the truckload. What were they buying for $1000?

These New York a-holes should worry more about what’s going on in their massive sewer and less about what’s going on in the fresher parts of the country; trouble is, the mayor of that urban crap hole is a grandstanding egomaniac who won’t keep his big nose out of other people’s business.
When I had an FFL many people didn't know what did and did not disqualify them. People who had DUI’s, misdemeanor convictions, etc. were genuinely surprised when they passed the background check that I was obligated to perform. For someone to just assume that they are prohibited because of something in their record without even bothering to fill out the form would have prevented them from purchasing a gun, which was still their right to do.
I look pretty shady right now. No weekend required.
Does the second amendment apply to only non-shady looking people?

30 weapons were sold and 4 people were arrested? Four months work and 1.5 million (taxpayer) dollars. Doesn’t sound like a very successful “sting” to me.
How many dealers refused to make a sale because they were suspicious. We won’t hear that number.

Could be a dangerous place for DHS to set up stings like this. After all, there are a lot of guns and amunition at gun shows.
Just need one spark to see the whole thing blow up. Remember that scene in V for Vendetta when the little girl gets killed by the DHS-esque “security squad”? The whole country, which was already pissed at the totalitarian government, exploded in rage and that government lost control. Obviously that was fiction but the way this country is going, with both parties hated and most people feeling the country has been going in the wrong direction for 6 or 7 years, all that’s needed is one big spark.
What the Hell are investigators hired by New York City , doing investigating stuff in TN,OH,and NV. Kinda out of their juridiction aren't they? Nevada is about 2400 miles from New York City..Las Vegas is over 2500 miles from New York City.

Don't most gun shows have signs that say "No Cameras"? The investigators should be charged with Criminal Trespass, and so should the co-conspirators who hired them, with taxpayer money no doubt.

seems to me that All these jack booted thugs just might themselves be GUILTY of Trying to Illegally purchase Firearms in a State they do not reside in. Where is the AG of these States??
Even a felony conviction isn't always a disqualifier by federal law. Restraint of trade, and a few other crimes are specifically exempted as prhibitors in GCA 68.
If people who are legitimately prohibited handle a gun and fill out the form then yes, they are in violation of the law. If they do so and are not prohibited then no, they aren't.
I had more people who were pleasantly surprised then unpleasantly so.
