Energy Czar Raises Possibility Of EPA Implementing Cap-And-Trade

There's more than one way to get cap-and-trade, President Obama's energy czar said today.

Carol Browner, the former Environmental Protection Administration (EPA) administrator who now serves in the Obama administration's newly created role of energy czar, floated the possibility today of the EPA implementing cap-and-trade energy policies, during an interview at The Atlantic's First Draft of History symposium in Washington, DC.

"We also have the reality of EPA, under current law, moving forward...to start the traditional regulatory clock," Browner said when asked, during an interview with Atlantic Media Political Director Ronald Brownstein, about the difficulties of passing the stalled energy/climate bill--which would implement a cap-and-trade carbon emissions scheme--through the Senate.

Starting that "clock," as Browner puts it, would "obviously encourage the business community to raise their voices in Congress"--since businesses could wind up with a less cohesive regulatory scheme, more difficult to comply with in multiple states, if the EPA moves forward on its own.

Environmentalists have pushed for the EPA to implement emissions reforms if Democrats can't pass a bill, circumventing the politics of Congress and using the EPA's environmental authority to get the job done, and there's a pending Supreme Court case on the matter.

But it's not viewed as a likely scenario--which some members of the environmental community readily admit--even as the reforms passed by the House have become mired in the upper chamber, with analysts skeptical that a formidable cap-and-trade plan will pass.

OH PLEASE DO IT!

Having the 0 come out and actually end run the Congress will wake up the Left leading "moderates" to what a bunch of fascists run the 0 regime. Nothing would be better suited to destroy the 0 machine then this sort of overreach

Unlike statues passed by Congress, agency regulations can be legally challenged based on their technical merits/scientific validity.

As Mark Levin loves to point out in his book "Men in Black," the U.S. Supreme Court ruled that the EPA can regulate CO2 as a pollutant.

This takes the cake for chutzpah. In other words, "we'll impose an arbitrary, screwed up set of agency rules so bad you'll wish you had a Cap and Trade Law to keep the EPA under control."

The words "administrative tyranny" are applicable here.

Lawsuits? Yes, there will be.

But this is a separation of powers issue.

The President can not govern by fiat, and that's what Browner is proposing.

We could be headed for a Constitutional crisis.

EPA bureaucrats must understand that there’s no real evidence of global warming and we’re still in the research phase on this issue. There IS a lively, active debate on global warming in the scientific community. The debate is NOT over. There’s no justification for this kind of radical cap-and-trade scheme that would crush the American economy just as it’s struggling to emerge from a recession. Is this administration insane? This is no time for all these proposals to increase taxes and regulation. All these proposals are creating uncertainty and fear in the business community, which causes business people to not hire workers and not make new investments. All these tax and regulation schemes must be dropped immediately so our economy can recover.

We’re already drowning in federal debt and this crazy administration is worried about the totally unproven global warming theory. This administration is filled with radical kooks and nuts with no concept of reasonable judgment. The GOP must take control of the House again in 2010 to save our country from the insanity of this extreme left-wing administration.

That's what I think. It will go to the Supreme Court. The Constitution says only Congress can impose taxes. "Section. 8. The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;"

Also: "Section. 7. All Bills for raising Revenue shall originate in the House of Representatives; but the Senate may propose or concur with Amendments as on other Bills."

You don't get it, do you? Congress would LOVE for Obozo to simply implement full Marxism without them. They'd love the policies and would have political cover.
