Judge: Texas Ban On Gay Marriage Unconstitutional (To the old USA, it was nice knowing you)

A Dallas judge ruled Thursday that Texas' ban on gay marriage is unconstitutional as she cleared the way for two gay men to divorce, the Dallas Morning News reported.

State District Judge Tena Callahan said the state’s bans on same-sex marriage violates the constitutional guarantee to equal protection under the law.

While the Texas attorney general had stepped in the case to say that since a gay marriage isn’t recognized in Texas then a Texas court can’t dissolve one through divorce, Tena denied the intervention.

This is the thing that always got me about this supposed Civil right to marry. It is called D-i-v-o-r-c-e. Civil marrigage is basically a contract. Why not just go to a lawyer and have one drawn up. NOOOOO this was and is about tearing at the fabric of the traditional family.

I would propose the unhappy couple move to Mass. or California...

Take a long romantic train ride, see if they can rekindle the spark that led them to civil union bliss...

And if it doesn’t work out for them, well, the move will handle two things...

Get them the hell out of Texas, and two, give them the opportunity to go to a state(s) to take care of their “legal” problems...

This is all a part of the gay agenda forcing themselves on other states even with laws prohibiting the gay marriage. If the judge recognizes the divorce then they are forcing recognition of the so-called marriage.

another illiterate judge. Equal protection? They have equal protection - each person can marry one single person of the opposite sex, assuming that person consents. That’s equal for everyone. Done - nothing more equal than that.

This activist should take their illegal rulings and move to a marxist leaning state and leave Texas alone.

They used the backdoor to over turn the ban by attempting to get a divorce.

And while this will be overturned, at some point there will be a case that goes to the SCOTUS and gay marriage will win n an EPC claim.

They have the votes, Stevens, Bryer, Ginsburg, Sotomayor and Kennedy.

If that were a valid argument, interracial marriage bans would not have been struck down by the SCOTUS.

That only is possible if you accept a gender-neutral definition of marriage, which most of us don’t... as evidenced by even CALIFORNIA’S prop. 9 passage.

Some people will propose “recall” or “impeachment”... I favor a more direct and attention-getting method: public hanging.

If Texas was to do that with judges REFUSING to obey the state’s Constitution, well... soon these judges would be reading and examining that document in earnest.

This is Dallas county and if you look at the voting patterns you’ll see they support Democrats in general. That said the ruling will be appeal by AG Greg Abbot and at some point will be overturned as it makes it way up the chain of appellate courts assuming.

Why is this concept so very difficult for lefties to grasp and/or admit?

Equal protection does NOT mean redefining well-known and universally understood terms.

The very term "gay marriage" makes just as much sense as "caucasian black", or "heterosexual lesbian".

Would it be a violation of "equal protection" if I was denied registration as a racial minority when I'm a white man? No! Why not? Because I'm NOT a minority.

Why can't two people of the same sex marry? BECAUSE THAT'S NOT WHAT THE WORD MEANS!

Marriage is, by DEFINITION, an institution involving a MAN and a WOMAN, with the main purpose of bearing children and raising a family.

That's what marriage IS. This movement is nothing more nor less than a direct, frontal assault on the very institution of marriage itself. It is a ploy to destroy the family by rendering the term meaningless.

...equal protection under the law...next they'll want equal protection to ensure that gays can use women's toilets and lesbians use men's - they get equal protection according to their status and if that doesn't include one male and one female, they fail the test for marriage.....

Gay marriage is a violation of the establishment clause.

Marriage is an establishment of religion. The state ruling on it is an infringement on that establishment.

That makes it a civil rights violation for anyone partaking in the religious practice of marriage.

There is no recall for judges in TX. The only officials that can be recalled in TX are mayors and city council members undeer a home-rule charter. People in TX like the stability.
