Schwarzenegger wrote he had "just heard" that the state's attorney general, Edmund G. Brown Jr., is opening an investigation following the release of five hidden-camera videos that depicted ACORN employees offering advice to filmmakers James O'Keefe and Hannah Giles, who posed as a pimp and prostitute, on how to skirt tax laws and avoid detection by authorities.
"Just heard from Atty Gen Jerry Brown that he is opening an investigation of ACORN in Calif," the governor wrote.
But according to a Sept. 25 letter from James Humes, California's chief deputy attorney general, an investigation had been launched last week.
"The Attorney General shares your concerns and he takes seriously his obligation to see that the laws of California are uniformly and adequately enforced," the letter read. "Accordingly, we have opened an investigation of both ACORN and the circumstances under which ACORN employees were videotaped."

This doesn’t sound like an ‘investigation of ACORN’, it appears to be an investigation of James O’Keefe and Hannah Giles.

Look, after all, we have to make California safe for Criminals to operate without fear, or they may pack up and leave for other states.
I mean, be reasonable... ;-)
When I think back on all those 60 Minute shows with hidden cameras, my saliva begins to boil. O’Keefe and Giles wouldn’t have had to do this ‘sting’, if the Attorney General of the state of California hadn’t had his head firmly implanted. O’Keefe and Giles are good people. And so they become the focus of the investigation.

I must admit that I'm a little surprised by the language in some of these statutes, including California's. I was aware that some states had two-party consent laws, but I wasn't aware as breadth or scope of conversations they included.
Just looking at it superficially, I don't think that these two are going to have any problems - at least not criminally. There's a least one case involving NBC that seems to give them some cover, all though the statute is a little ominous as it's written. It is California, so anything is possible - not to mention expensive to defend should you find yourself under criminal indictment, or the defendant in multiple civil suits.
California is a big lib state, but it's also a state that has a strong 1st Amendment protection lobby. I'm not so sure it would be a smart political move for Brown to push this issue, even given the fact that it's a conservative media team that's the target.
The problem for Brown is that he sees himself as a viable Gubernatorial candidate for 2010. If he pushes the prosecution of these two kids, he won’t be viable for dog catcher. There are a lot of Independents and Democrats who are waking up to what is going on right now. He could destroy himself much the same way Obama is, if he’s not careful.
These kids are to be admired. They really had some moxie to do what they did. What a great coup.

Sounds more like he is investigating the two kids who video taped them then he is ACORN. Brown is a first class liberal and I wouldn't be surprised if he has ties to ACORN, he hates gun owners and that's a fact.
