Department of Health and Human Services Secretary Kathleen Sibelius has not only given immunity to the makers of Tamiflu and Relenza for injuries stemming from their use against swine flu, she has granted immunity to future swine flu vaccines and any associated adjuvants. The last time the government embarked on a major vaccine campaign against a new swine flu, thousands filed claims contending they suffered side effects from the shots. This time around, they will have no recourse.
The 2006 Public Readiness and Emergency Preparedness Act (the PREP Act) allows the DHHS Secretary to invoke almost complete immunity from liability for manufacturers of vaccines and drugs used to combat a declared public health emergency.

Can she “grant immunity”? On what basis can a civil suit be quashed?

I am all for tort reform. I am not into bashing the pharmacy industry. However, NOBODY should be granted blanket immunity for bodily harm given the stakes. This is simply a move towards mandatory immunizations so local and state officials will have cover.
To liberals “choice” only matters if the problem is killing babies.

And that is what makes this EXTRA worrisome. Do a little research on Squalene. Novaris and Glaxo-Kline-Smith are reportedly using this in the manufacture of the vaccine. I sure hope those healthcare workers in NY get together and walk out before giving into that mandate. It may save their lives.
So the NJ state government is going to FORCE children to get the flu shot and there is no legal recourse if something goes terribly wrong?
BTW, DO NOT get the nasal spray vaccine as it contains the LIVE virus.

IMHO I think it’s because of the squalene which is suspected of causing Gulf War Syndrome.
There are a LOT of people who are not aware of the fact that they have an egg allergy. Especially children, where the affects haven’t been figured out. This vaccine is egg based and can be extremely dangerous to people with egg allergies. It can kill and be much more deadly than the flu itself. Forced immunization with immunity is absolutely frightening. People should be screaming about this breach of our rights. Do not allow yourself to be vaccined if you are not sure if you have an egg allergy.
If those vaccine makers get immunity, then the people should be able to make the choice whether or not to get the shot! Simple as that! Sounds like they are expecting problems from the vaccine! I will not take it!

Everything is complicated these days. What I see clearly, to cut to the chase and the quick, is a fascist leftist/Marxist government trying to force-feed us all a diet of government-controlled, nanny-state, ‘cradle to grave’ (emphasis on the grave part ala end of life counseling/death panels) healthcare... wherein they can also force us to accept vaccinations that may or may NOT be safe with no recourse but to suffer the unknown consequences, force us to take the insurance at penalty of fines and/or imprisonment, and force us to do any number of other, currently unknown or unlisted, government-mandated edicts.
Not so complicated, really.....when you look at things with unclouded (ie unliberal leftist) eyes.

You’re exactly right. Vaccines are not very profitable to begin with, couple that with the liability/malpractice angle, and nobody wants to make them anymore. That’s not really the fault of “Big Pharma”. Those with long memories (not me) will remember that the first iterations of the Polio vaccine in the 50s had problems. I recall that somebody in the line at Ft. Dix, New Jersey dropped out of the line at the innoculations during basic training. Always wondered, never saw him again.. It sucks, they made us all take the Anthrax shot. Was a pincushion prior to that even!!

This isn’t new or unique. Immunity for drug makers was initially granted by Ronald Reagan in reply to shysters of the John Edwards variety. The industry was crippled and on the verge of being pushed out of the United State entirely. As it was we lost most of the smaller companies.
I hate shots as much as anyone and probably more then most, but geez. I’m halfway down the second page of FR tonight and this is the fourth immunization hysteria article I’ve seen. I think tonight will be a record.

That’s right - vaccines were not profitable so the drug companies did a cost benefit analysis - too many costs, not enough benefits. They then threatened not to invest any more time or money into research and development, so the government gives them certain protections. Imho, a better balance should have been achieved between public health concerns and drug company demands.

Does anyone know if squalene is present in the regular annual flu shot (not the H1N1 shot). I’m scheduled to get the regular flu shot tomorrow and have the past several years without problems. I’m shying away from the H1N1 shot for now. Thanks - OB1
