Democrats aren't satisfied with the one-party state in which they control Congress and the White House and can politicize the Justice Department and take over the banking and automotive industries. Now liberal Democrats are pushing a court-packing scheme as well.
A subcommittee of the Senate Judiciary Committee will hold a hearing Wednesday on the proposed Federal Judgeship Act of 2009 (S. 1653), which would create positions for 63 new federal judges - 51 in federal district courts and 12 in appeals courts. This proposal is nothing less than a sneaky equivalent of what President Franklin D. Roosevelt tried with his infamous court-packing power grab on the Supreme Court in 1937. The only slight difference is that this attempt is more under the radar.
The Supreme Court has been choosing to consider fewer cases each year. This means the lower courts provide the final disposition for a larger percentage of controversies than ever before. Packing those courts with new, loyal liberals can thus have a huge effect on legal issues without the high profile - and public backlash - of unpopular Supreme Court decisions and fringe appointments to the high court.

The present judicial districts have enough judge positions to handle the existing workload. There are a number of unfilled vacancies and these can be filled if a district has a high case load. I’ve followed the news on Wisconsin’s eastern and western districts and the judges are not overworked. A couple are eccentrics and duck case assignments on issues not related to real conflicts of interest. If the circuit heads stepped up and told these guys to shape up, the work loads would be better distributed.

Two members of the Court caved, giving FDR a reliable majority, and the Supremes decided every case pretty much how he wanted for the next decade.
Bush to his discredit left many court openings. Obama has a lot too, but with his failures , his campaign advisors know that the only way for the Left to keep relevant is to appoint those jurists that they need. And now, he is not going to make the same mistake that W did. And the Pubs cannot stop them unfortunately.

Whose discredit? You saw what a complete mud-fight occurred over every confirmation! The Stupid Party never gave Slick such a fight over his liberal appointments. And now, they couldn't do it if they wanted to (which has always been open to question.)
