A Suffolk Superior Court judge today denied a motion by state Republicans to delay Gov. Deval Patricks appointment of an interim senator by 90 days.
Judge Thomas Connolly this afternoon cleared the way for Paul G. Kirk Jr. to be sworn in as an interim U.S. senator today at 3:15 p.m. in Washington, D.C.

Probably not. Justice Chase, in Calder v Bull, laid out the four principles that have guided ex post facto decisions ever since. None of those four principles apply here. The law was passed, then Kirk was appointed.
Now, I'm not entirely convinced that Kirk's appointment is allowable under the new statute. I'd like to read this Superior Court judge's decision to see exactly what his reasoning is for denying plaintiff's action.
This is outrageous, and blatantly obvious political interference and corruption of the courts.

I agree with the poster above, this is NOT an ex post facto law. From wikipedia but surpisingly accurate: “A law may have an ex post facto effect without being technically ex post facto. For example, when a law repeals a previous law, the repealed legislation no longer applies to the situations it once did, even if such situations arose before the law was repealed.”

It’s a state law.
In this case, I would agree, but broken laws (or ignored ones) are still broken laws, something which doesn’t seem to bother Democrats one whit.
