A recall petition filed Tuesday against a member of Congress could end up being a test case for whether Arizonans have the power to dump federal lawmakers. Tucsonan Thomas D. Young is seeking the ouster of two-term Congresswoman Gabrielle Giffords, citing her support of federal legislation requiring increased use of electricity generated from renewable sources and new carbon emission standards for coal-fired power plants. Young complained those standards will raise the cost of materials by more than 30 percent.

It doesn’t state her party affiliation. She must be a dem.
Yep.
Petition? She’s worse than awful but I don’t see a petition in the Constitution. Will a note from a teacher work?
The morns elected here .. the “note” from the teacher is called the “election’ process. Maybe the stupid electorate will get it right next time
Reminds me of all those eltitist Inty leckchual, moderates ... Obama .. howzatwokin out forya
Unconstitutional. You cannot recall a federally elected official.
Section. 4.
The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators.
Amendment X
The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
Johnny Mac had people working on his recall prior to 911.
She is a Blue Dog which means she is fundamentally dishonest.
I can think of a few Senators I’d like to chus.
I would like to see this recall thing rolling on about 3/4 of the congress critters. Let them know they are OUR employees, not the entitled elites they think they are.
I double checked the spelling and it is on archive that way.
Seriously, I'm glad someone actually decided to quote the pertinent parts of the Constitution before spewing clap-trap about how Federal officials are exempt. That's exactly what they think.
Arizona constitution allows recall. Since she “represents” the people of a district in ARIZONA, then they can recall her since it is allowed in OUR constitution. States still do have rights you know, it’s written in the other constitution.
Worse than that, she is a ex-republican.
Who is dumber, Boxer, or Giffords?
I can’t decide.
Ping.
That thing don't matter no more, doncha know!
She signed a promise to step down if recalled when she was first elected. It has no legal force, just like the recall effort, but it will be a stake in the heart of her incumbency if she goes back on her word.
There's no "recall" provision in the Constitution. If she was legitimately elected, you have to live with her for the duration of her term.
Once again: ELECTIONS HAVE CONSEQUENCES!
No wonder her most recent fundraiser was held in Delaware...........

Democrat promises is for suckers.
True, that.
Jesse Kelly is our best shot at getting her out of there.
10th ammendment; because if it is not expressed in the Constitution it goes back to the state to decide.
Say what the naysyers want but I support the people of my adopted home district and will be watching to see the outcome. If someone tells me I can’t do it just because they said so, I do everything within the means of my capabiities to see them eat their words.
Just a little rubbed off from our founders.
Not quite, but nice try.
It's a federal office. The state can't make rules controlling a federal office or election.
Even had AZ been a state prior to the adoption of the U.S. Constitution, it still wouldn’t be able to recall members of Congress. As you mentioned, Article I is very specific as to the qualifications and election of U.S. Representatives, and only the House itself may expel a member (by a 2/3 vote).
Thanks for the ping.
Hopefully this will prompt her to keep her promise to step down if she loses a recall vote.
Yeah, right. Dream on, .44. She’s a politician.
You’re welcome, .44! I love how Karamargin, former Red Star staffer turned Giffords staffer, is already proclaiming her queen for life... (well, ya know...)
Mr. Flat Toad — Sorry, I forgot to ping you the first time.
Seems like this recall petition should be signed, maybe, the first week in November, 2010? At the AZ polling place perhaps?
Not all conservative/right-wing/activists are “right” ....
They don't. Not until November 2, 2010.
Article 8, Part 1, Section 1: "Every public officer in the state of Arizona, holding an elective office, either by election or appointment, is subject to recall from such office by the qualified electors of the electoral district from which candidates are elected to such office."
Congressmen are not state officers.
You and I are on the same page.
..you and I are on the same page...

Ditto here...
However, I am getting a little ‘tired’ of seeing this thing coming around stating that in 2010 1/3 of the Senate and the entire House of Rep are up for re-election.
We have been having elections every 2 years for a century or two—may have been harder to ‘oust’ Senators up to 1913 or so, seeing as they were appointed but the premise remains the same—If you didn’t like the state people appointing Senators, vote them out.....
I’ve never been convinced that the 17th ammendment was the right thing to do .... long before my time though, although at times I feel that old (pass the geritol my friend)
We have created a situation with additional thanks to that insane campaign finance reform (aka McWorthless and Meingold) tht made it even harder financially to un seat an incumbent senator. it was a career enhancing reform for those already elected. War chest are huge and daunting.
But... perhaps somthing will happen 2010. Optimist, but as I am always and daily taught in the finance world, SEC dictates I say it ...past performance is not guarantee of future
