Senate approves Kennedy successor bill

State senators passed a bill today 24-16 allowing Gov. Deval Patrick to pick a temporary U.S. senator by the end of the week following a final procedural vote tomorrow.

If the House and Senate pass the bill, as expected, tomorrow a temporary senator can be chosen to fill the seat left vacant by the late U.S. Sen. Edward M. Kennedy. A permanent replacement will be elected by voters during a Jan. 19 special election.

I am so ashamed to be living amongst these corrupt polls. The "will of the people" is completely discarded by those we (I use that loosely) elect.

How is this not an ex post facto law? If there is a law (and there is) when the “opening” occurred - that current law MUST be followed in order to fill that position. Now, the NEXT time an opening occurs, then they can use the interim appointment, but this is simply illegal!!!

All it SHOULD take is one MA resident to file a complaint.

This is a state issue. If a law has been violated by this change, it will be a MA law, not a federal one. Prior MA law required that the seat remain vacant until the election takes place. Now, the election will still take place, but they’re changing the part about it remaining vacant. I doubt MA courts will care.

Why doesn’t Massachusetts just hire Castro and get it over with?

Better yet, why do not the inhabitants of Massachusetts simply move to Cuba and complete that which they are approaching asymptotically?

Then the rest of us can repopulate the state with folks who actually understand the constitution.

Not a done deal yet. Senator Brown is on the Howie Carr show saying that the house needs a two-thirds vote to make this work. They are a few votes short. Even some Democrats didn't follow the Rat leadership on this.

Hey, let's not be too hasty now -- more federal laws are rarely the right solution. Disagree with the choice, sure, but the states are completely within their rights by The Constitution to decide for themselves how to pick Senators.

So no one remembers when Wyoming's Dem governor picked Republican John Barrasso to succeed Craig Thomas in the Senate when he died in 2007? He was "required under Wyoming state law, able to consider only three individuals whose names were submitted to him by the Republican State Central Committee because the seat was vacated by a Republican."

Every RAT counts as Reid attempts to ram through Obamacare health deform using the budget procedure of “reconciliation.”

This underscores that the RATs are planning to use reconciliation (only 50 votes needed to pass the measure). Why else would they be scrambling this hard for one simple addition RAT Senator?

Awww. The State Constitution is merely a guide. When you have the political majority you can do whatever you want. Of course, if another party takes control in a few years, they can point back to this precedent set by the Liberals and say, “See, Its OK” That’s why all Democracies that abandon the rule of Law for political expediency end up living under dictators. Oh well.

The original Constitution made State Legislatures exclusively responsible for Senatorial appointments.

After XVII, legislatures were given the specific power to do what the MA legislature just did (instruct the Governor to appoint a temporary Senator), so, no - there is explicit federal Constitutional authority for this law, it can't violate the ban on ex post facto laws, therefore.
